Please get your facts right. At 12:30 the UK will formally give notice of its intention to leave the EU, at a date to be agreed. It will remain a member of the EU until exit negotiations are complete, which could be around 2 years away, or longer if the other member States agree.

For the time being, the UK is still part of the EU and UK citizen's rights within Spain and other EU countries remain unchanged.

Pete.

Im sorry but I disagree,we trigger article 50 .that tells the EU we are leaving, we then have two years to negotiate terms of our departure...that is my understanding, if you can point me to an official document that says otherwise, I would be grateful.

You seem to be contradicting yourself - you start by saying that as of 1230 today the UK is out of the EU, then agree with me in saying that departure will happen within 2 years!

To clarify the situation for those people who are panicked by what they are reading here, the facts are as follows:

At 12:30 today, the UK formally served notice of its intention to leave the EU, triggering Article 50 of the Lisbon Treaty.

The UK will formally leave the EU at a date in the future when agreement has been reached between the UK and the remaining EU member States on the terms of the withdrawal. Or, if no agreement is reached then the UK will cease to be a member of the EU two years from today. Unless, the UK requests an extension to the two year cut-off and this is agreed by the remaining member States.

The UK remains a member of the EU until the agreed exit date, or until the two years have elapsed.

It is unclear if the UK could withdraw its notice to leave. Should this situation arise the request to remain a member would need to be decided by the European Court.

Once the UK leaves the EU, if it wishes to return it would need to re-apply and go through the same process as any other country wishing to join the EU. If Scotland wants to become a member in its own right then it too would have to go through this process.

The important think is that THE UK HAS NOT LEFT THE EU YET, and your UK passport, driving licence and EHIC card still give you the same rights and benefits in Spain that they did before. If you encounter Spanish officials who, like the original poster, think that the UK is no longer a member of the EU then they are wrong.

For those people who disagree with these facts then you should read this briefing paper from the EU:

Quiet a lot to go through Pete but I did note at the end.......
The content of this document is the sole responsibility of the author and any opinions expressed therein do not necessarily represent the official position of the European Parliament.
Sort of makes me wonder??
But if what you say is correct that is great for the remainers, we cant get a satisfactory deal after two years so we drop them a note and say we have changed our minds , think we will stay In honesty, I may well be wrong in what I said we cant back out of article 50, I have read different articles some claim that we need to trigger article 49,I dont believe anyone knows for sure, it may be for the ever helpful Ms Gina Miller to sort out.
I will agree that we didnt actually leave the EU today but I do believe that we issued our intent to leave and we now have two years to try and get a deal. I don't know how or what the machinery is to reverse the triggering of article 50...can someone help me with this?

I thought you had already figured that out.

No! The UK has triggered article 50, but is still a member of the EU until the negotiations have concluded! So simple, why can't you understand that?

Yes I must apologise to all, my statement was not correct, what I was trying to say is that I do not believe that there is machinery in place to withdraw article 50, and as such we are ON OUR WAY out of the EU and I am not aware how the process can be halted.

The last thing I want to do is to get into get into a sterile row but to spell it out, you asked Davec "Wellcan you tell me what has changed that would warrant that please" in relation to what would warrant another Scottish independence referendum. It seems to me you already conceded the point in your initial post - above in bold for reference.Hope this helps.

Thank you for the big text, but not really necessary. What has changed as I understand is SNP wrote a clause to say that the last referendum would be a one off, unless the were significant changes that effected Scotland. Ms Sturgeon claims that as the majority of Scotland voted against Brexit, that would effect Scotland, so the Scottish Parliament has given her the go ahead to request another referendum, to which Mrs May said....not at the moment, hope that clarifies...The SNP feels that is a just cause for a referendum, as does the Scottish parliament...unfortunately I have no influence over either....Thank you for clarifying your original post , correct me if I am wrong but I thought that you were all in favour of an independent Scotland

What makes you believe we are all in favor of breaking up the UK. I am not for one and to me there is no way Scotland can support itself and unlikely to enter the EU.
