Advice please, we have seen a house we would like to buy and made an offer through the agent. This was refused but subsequently the vendor approached us and said the agent had told him we had made a very low offer! He then told us what he would accept for the house, and that should we wish to proceed he would bypass the agent. Can he do this, and would it be safe for us to go down this route? Also should we choose the solicitor?

nothing to stop you buying the house direct from owner but get your own solicitor

Even if you do end up buying through an agent, dont use their solicitor, always choose your own, independent solicitor.

The Agent has introduced you to this property and is therefore entitled to his fee from the vendor if you proceed to buy this property from him either directly from the vendor or via the Agent.

Be aware,,,

Does the owner has a contract with the agent ??? And the agent has introduced you to the vender,
Then the vender is being very naughty bypassing the agent, and a simple land registry inquiry by the agent at a later date once the property is sold will show this to be the case.

Also, are you happy to bypass the agent, why, this is their lively hood !!!

Next question is,,, why would the agent undermine your offer ??? This does not make any sense, When you and the vender finally agree the purchase price, then any commission the agent is paid will come out of this and from the venders purse,,, not yours, your offer is your offer,,, the only winner is the vender bypassing the agent !!!

Next thing you will have the vender asking if you would like to a part and part cash purchase, ''to save you paying unnecessary taxes'' and declaring to lower price at the notary and to the solicitors,,, !!!

Ask for second viewing,,, Then Just make your offer what you are prepared to pay in front of the vender and agent ,,, Don't Be Shy, its your money, agree a price

Sign the reserve contract and pay your deposit to YOUR solicitor who will keep it save in esco,

If you do need an independent solicitor who is confident, speaks English and knows his job and the area, do not use one recommended by the agent or vender,,, Try Jose manuel @ sanchez burton abogados,,,

I know a lot of the agents are iffy to say the least! (not saying all of them) but when the agent has introduced you the vendor and the vendor now wants to renege on the contract they are just as bad to try to bypass someone who they employed the services of and have an agreement with!. Can these people be trusted? its your choice whatever you decide to do but get an independent solicitor of your own choosing.

I can recommend Mar at Sol 4 in Benimar she will make sure everything is totally legal and at a reasonable cost.

As has been said above about paying cash if you come to sell the property and you have paid a large amount of cash not declared at the notary you will be liable for capital gains tax at 19% on profit so bear this in mind for the future!

whatever you do go back to the agent, something smells a bit fishy here, stay safe and good luck
