What are the rules regarding distance to neighbours line?

We understand that it's quit strict rules and regulation for building a kitchen/small house regarding min 3m distance to borders/neighbours property. So we consider to set up a pergola in aluminium and canvas roof instead. Can anyone give me advice and insight in regulations and rules regarding distance to neighbours line, setting up a pergola? The rules are different depending upon where in Quesada your house is. In some areas the rules are 3 metres from boundary walls in others, 1.5 metres from neighbouring properties, so you really would be best to speak to the town hall. They are usually very helpful and, because your question is quite simple, they should be able to answer quickly. Remember to take your plot number and address in order that he can better identify your house. Also, tell the town hall what you intend to construct because you may well find that a temporary construction (no brick, cement or foundations used and within height limits) may be exempt from such legislation anyway. Thank you'! It means that it may also be necessary to apply for permission to also set up a provisoric pergola tent in the garden, close to neighbours wall?

Check what you want to do doesn't infringe on community regs if you're on a community. We can't do a number of things, one is have a pergola if we use its side panels! True!

Hi newchocs Quesada is under Rojales so rules are the same no mater what part you are from, community rules may vary but town hall applies all over the 03170 postcode!. always check with town hall or qualified architect.

We had the same problem but went to the Town Hall a free standing type that is not built of brick can be used and needs no planning permission, but we asked for it any way. The Community President said no to this as they tried to say it changed the esthetics of the building. Town hall laughed. That Horizontal Law relates to actual brick work put in to place and not a temporary built Gazebo . Ours could be moved. If it is not in the statutes or local ruling of the community it is best to just ask your neighbours if this would offend them. The community would have to vote on this at the AGM if you do have a problem. Also for any illegal buildings within the Rojales area , if they have stood for 4 years there is nothing your community can do. Just be polite ask your neighbours and President and check statutes and local rules of the Community. The President on his own cannot apply his own rulings he is just the mouthpiece for the rest of the Community.

Hi Scubydoo,
The rules in Quesada do change depending upon the location of the plot. In some areas it is possible to construct more m2 and in others not. There are localised rules for areas, usually dependant upon the age of the area and the rules which were in place when the first construction was in place. For example, most plots in Quesada one (near the centre) allow a maximum of 30% build per plot (150m2 construction per 500m2 plot) while in other areas of Quesada, this rule can be much greater. The rules regarding the proximity to the neighbouring walls also vary, from having to be 3m from any boundry wall, to 3m from the neighbouring house, which can mean just 1.5 metres from the wall.
So as you see, even within an area in the same town or same postcode, rules do change. That's why you need to check very carefully before deciding you can extend a property or build a new structure on any plot.

I'm going to apply to the council to have my front walls made higher and taller gate put in (most in my street have done so over the years.
Does anyone have a rough idea of how much the building license will cost me?

Hi it depends on the length of the wall and the hight you are raising I would get the builder to apply as they know how to manipulate the sysem in your favor!
