We already have Spanish wills which cost us 400 euros ...now we will have to change them with this new ruling ..Anyone know how much it will cost ?........ Spain is getting on my nerves with all the changes.... :roll:

Only if you are Resident. The new rule does not affect Non-Residents apparently.

You could look into how it would affect you if you didn't change them. It does seem to be a nuisance for everyone and Wills in the UK don't seem to ever change, except when we need to change them due to personal changes in circumstances. :?

This is a really simply process that is cheap and easy to do. Just go straight to the notary and avoid paying commission for someone to make the same appointment for you. We have just done our s at the notary in Rojales, friendly! helpful and the whole thing took about 45 mins and cost 60€.

I seem to remember seeing a Notary in Rojales opposite the Town Hall on the other side of the river.

Jan is right, in her previous post.. You need to check if your will actually needs changed before doing anything. There is of course the question of whether you're resident or not, but also your circumstances will dictate whether you need to do anything. I spoke to Silvia at SGM Abogados in Benijofar and she told me that my circumstances were simple and as such that changing my will would be pointless and a waste of money. So, free advice and no need to bother changing anything. Like Jan said, check first, before paying to change anything. :)

Hi,
We have a property in Spain but have never been resident. Is our UK will sufficient to cover our Spanish property or does it automatically come under Spanish law.We seem to be getting conflicting information from our fiscal.What is the legal requirement for a non-resident regarding wills.
We are concerned that as non-residents we will not have a say in who inherits our property. Any advice appreciated

We are non-residents and have Wills both in UK and Spain - We were advised by our Abagado & Fiscal Rep that it was a good idea to have a Spanish Will for the following reasons (taken from their website):

Quote from our Abagado website "We are often asked, why make a will in Spain? Our answer is that making a Spanish will can save your relatives time and money. Knowing more about Spanish inheritance tax means that you can plan more knowledgably how to leave your inheritance.
Making a will in Spain means that there will be no need for your benefactors to get an interpreter or have your will authenticated. This makes the process quicker and simpler for all concerned. An important factor at this difficult time. At Ábaco we can give you the advice you need to make a Spanish will work for you and your family."

Therefore it seems it isn't obligatory, for a Non-Resident, but it's advisable to have a Spanish will. We decided it was best for us to have one so as not to put our family (or either of us) through unnecessary stress and bother when the time comes.
