Does anyone know the following.If the only asset s in Uk are banks accs & investments (no property) is it necessary to use a solicitor in UK. Being fiscal resident in Spain with Spanish Wills we know that death certificates issued in Spain are compliant in UK. So , can these be passed to the appropriate bank or pension provider ,personally. Hope this makes sense.

Unless your will has the following written in it you will need to make a new one. You cannot have a codicil here in Spain has to be re-written unfortunately!!!
According to this law, article 21: “Unless otherwise provided for, the law applicable to the succession as a whole shall be the law of the state in which the deceased had his habitual residence at the time of death”. Article 22: “A person may choose as the law to govern his succession as a whole the law of the state whose nationality he possesses at the time of making the choice or at the time of death”.

As I said in a earlier post, I spoke to my lawyer, Silvia Galve at SGM Abogados in Benijofar and she told me there was no need to change my will because my circumstances are simple. So please remember to check first, before doing anything. I know Silvia is always very honest, but it pays to remember that lawyers, notaries and "advisers" make money out of this kind of change.
