Renting / Renter problems advice please?

Renting / Renter problems advice please?

Postby Robert brannigan » Sat May 13, 2017 11:39 pm

Folks. Looking for advice. I'm in a bit of a situation at present. My apt has been let out and I have been told that the person who was staying there has been arrested on a drugs charge. As a result of this I am not allowed to enter the place until the case goes to trial!!!! My concern now is whether or not he has left food items out or he has left the electric on, i.e., air con. I can't log on to my on line banking and I have requested the bank to help. All quiet at the minute I'm afraid. Nothing coming back in a hurry!!!! This could take a further 3-4 months according to the police. Without spending a fortune which I can't afford, has anyone experienced my situation and if so is there any way I can gain access to check my apt is ok???? I'm at the next stage of cancelling my DD for electric and water o that the supply will cut. Bit drastic but feel that this is my only option!!!!! Any tips would be appreciated!!!! Many thks.
Ps, my letting agent has even dropped off the rador!!!!

The only sensible thing to do right now is go to a solicitor.

..there are some on here that people recommend....

Good luck...you might need some...

This is a very worrying situation for you. Obviously the solicitor advice suggestion is sensible and needs to be considered but understandably could be costly if you have to take it further than just advice.

How did you hear or know that you are not allowed to enter? Could you somehow find out (maybe with a translator if you need one) if you as the owner can enter the property, even if it's with a police escort, to check on the things you mentioned above?

Also is your bank problem connected to this situation? If not then, if you are in Spain, go into the bank to sort that out.

As you were with a letting agent, maybe the police will need the name of this agent to help them with their inquiries and you could offer this information to the police.

I wonder if a solicitor would be happy to just send a letter explaining all this to the police for you. You should not have to agree to any further costly proceedings at this stage but just ask for advice and possibly a letter to be written for you. However you will need a good English/Spanish speaking solicitor to get your point across in the first instance.

Why not send an email to a couple of solicitors outlining what you have said above and see how they respond?

I know these are good at responding by email and have English speakers : http://www.abacoadvisers.com but there are others recommended on this forum, if you search, and you could see what they come back with - It will cost you nothing to ask.

Good luck.

If you,ve got a set of keys, whos going to know if you,ve been in the apartment, just to check? also the agent surely must do a monthly check on the property,to see alls well.Ask the police if they will escort you in while you check everythings ok .Who let you know about the present situation?

Guys. Thanks for the advice!!! A solicitor has agreed to work on my behalf...... at a cost of €1700 so you can imagine what I said!!!!! The police have made it clear that no one is to enter. My only option at present is to disconnect the power and water, which in turn will create another pile!!!!! My apt is right at the front of the communal area so I'm sure the word would get out that I have entered the property!!! As I'm in NI I am relying on the estate agent but they have not replied back!!! Would there be any way that the power would be switched off at the meter??? Any advice at this stage would be great!!!!

Yes you can turn the water and power off from the mains cupboard outside the property which you should have a key for. We turn the water off from the cupboard outside each time we leave the property. We could turn off the power too but we have security in the house.
No reason why you cant do this or get someone to do it for you if they have your keys.

I am not sure now about the mains electric cupboard outside as we don't turn it off but someone may be able to tell you if you can.
