Hi has any1 had any dealings with Euromarina, I have a contract with them and they have part payment but I'm no longer in a position to complete, due to illness and I'd like my money back! They're saying not possible

I have very limited knowledge on this, and others can give you better advice I am sure. Euromarket have been established in this area for a very long time and have built a lot of houses here.
I would recommend that you firstly study the contract you signed with them. Then, if necessary, consult a solicitor because the contract should be based on Spanish law. In the UK, contracts have to be 'fair and reasonable' and I would guess the same would apply in Spain.
Perhaps it might depend on the circumstances? If Euromarina built a house specially for you, they might argue they made a major financial commitment and are now left without a buyer and the deposit is forfeited to cover their building costs. On the other hand, if the property was already built and just sitting there unsold, you might be able to argue that the loss should be low just to reflect any inconvenience to them?
As I mentioned above, you need to clarify what commitment you made under the terms of the contract you signed. I hope you get a good result.

Not sure if new builds are different but when buying resale 10% deposit is non refundable if you back out of sale.
