RETURN OF BANK/BUILDER DEPOSIT

Has anyone, or knows of anyone, who has successfully had their deposit on property returned via a solicitor and how how long has the process taken. I employed my solicitor a year ago for this process and still waiting for a result.

We are in the process of trying to get our money returned. In 2006 we took the builders to court and eventually won, but they went bankrupt so we lost even more money. Now we are trying through the bank. The Spanish court passed a ruling to say the banks should have guaranteed our deposits but although it sounds cut and dried we have been waiting 18 months and it hasn't come to court yet. Our solicitor had kept us upto date with the proceedings but things are different here and move very slowly so I think 12 months isn't unusual. Just ask the solicitor what is happening, but I'm not sure how to get in touch with you privately on the forum so can't tell you any more at the moment.

W are in a similar situation after the Fortuna project went belly-up

Only 45000 euros lost !! The deposit should never have been paid to the builders

Only yesterday did our lawyer email us saying preliminary court date is this February with final date later in the year and likely it will finally be resolved then - we'd written it off so anything returned is a bonus

WOW €45,000 ,you can afford to write that off....you lucky people to take that attitude ,if that was me that would be my life savings,i don't know what I would do.

Well my amount is double that of Mr Pulman so I cant leave it at that in fact my husband died which makes me think the strain of all contributed to his death as he wasn't ill it, was sudden. Every ones situation is different and I can understand someone giving up and feeling helpless, so being flippant doesn't help, I hope I don't pass away before I get a result and my Spanish solicitor has been fighting this all this time so I don't feel I can change now we have come this far. I would like to ask Joyce which court it is held in as maybe that would differ from area to area.

We have been in the same situation, but have found that the Spanish solicitor was as much a ripp off as the developer.
We paid our money for him to deal with things and then he kept asking for more as the case seem to need more and more info so that he could win the case.
We gave up in the end and used a U.K claims company, now we are happy and about to get all of our money back.

It only took us 5 months from start to finish with the U.K company so you can get things sorted quickly.
