Another query
Our personal pensions and rental from uk house are taxed in uk .....if we take Spanish residency do these become taxable in Spain
A friend who is in a similar position to us has got Spanish residency but still pays tax in uk ......all very confusing.....well at least to me
Only government pensions (like forces, police, civil service etc) should be taxed in UK. You should write to the HMRC with a P85 form (there's one on the HMRC site). That way your state pension, when you get it, private pensions and interest will not be taxed in UK. You then complete a tax return in Spain.
UK rental tax will be taxed in UK. You then declare that on your annual income tax return in Spain and any tax you have paid in UK will be offset against your tax in Spain.

The simple answer is "Yes". If you've lived in Spain more than 183 days in any one tax year, you are regarded as tax residents of Spain, irrespective of whether you have gone through the formal process of applying for Residencia. The extract below is from: https://www.expatica.com/es/finance/Gui ... 01437.html
"2) If you are a Spanish resident
"If you are a Spanish resident you will be taxed on your worldwide income. You may deduct your income tax paid in your home country.
"Double tax treaties are in place to avoid double-taxation. When there is no treaty with your country of origin, you may deduct the foreign tax paid; foreign compensation may also be applied. Your Spanish Lawyer may calculate this amount for you.
"Non-residents living more than 183 days in Spain are also considered residents for tax purposes, even if they have not obtained their residence permit."

You apply on the same form EX-18 for an NIE and residency if you haven't already got one.

Wherever you go, you have to book an appointment online first. Best to check which one has the earliest appointment because you can wait a month or two sometimes.
