Residency for UK man and foreign fiance
Residency for UK man and foreign fiance
by retief » Sat Oct 28, 2017 11:05 am
I am UK man about to move to Spain to live permanently .My Fiance is Thai and still lives in Thailand . We plan to marry and want to live in Spain permanently. My question is ........ Would it be better for my Fiance to come to me in Spain and we marry in Spain ( preferred option ) or would we have to get married in Thailand and then move to Spain ? (I will get my Spain residency first either way )Any help or advice would be greatly appreciated .

If you are not married she will require a visa to visit Spain which will only be valid for 90 days. She will need proof that she has a return ticket to Thailand when the 90 days is up.
To have a civil wedding in Spain, you have to show 2 years of residency.
If you want a church wedding one of you has to be Catholic. It will take at least 6 months to get everything prepared so a 90 days visa wouldn't be long enough. All documentation, birth certificates, divorce certificates, no impediment to marriage certificates, baptism certificates and so on, have to be translated into Spanish and notarised.
If you're married before arriving, she would need to apply for an EU national family identification card on an EX19 form.
I'm assuming she's not a UK resident so I'm not sure if you would need to be resident in Spain before she can join you permanently after the 90 days expiration date of the visa.
Good luck.

Hi Marcliff , Thank you very much for your reply. I see from your advice that I must rule out getting married in Spain .I will become resident in Spain ASAP because of potential Brexit affects . She is Thai resident , so then we will get married in Thailand and then we will attempt to live in Spain . From what I have read I believe she will then be entitled to the same benefits as me in Spain , as my spouse . I spoke to the Spanish Consul but , although most polite , was not helpful . If any other readers are in a similar situation to this I would welcome your comments on your experiences in this situation . Any advice , comments or help will be appreciated .

Hi Javjee, Thanks so much for your reply , what you are suggesting is what I was thinking also , so I hope we have both got this right . I wondered if you know anyone else who has done this or something similar . If anyone can give any comment at all on this subject please do so , any small nuggets of information could be very valuable .
