Dear all,

A reminder that on Monday next 12th February 2018 at 12 noon, the British Consul will be addressing British citizens in the Capitol Theatre Rojales, behind theTown Hall.

As seats are non reserved, anyone needing specific seats for disabilities, etc, are advised to arrive early so we can endeavour to attend to any special needs.

Wait and see was the consensus.

The only real advice was, get residencia.

Welcome and expressed his pleasure at Rojales hosting this meeting. Brief synopsis of the number of ExPats living in the town, potted history and how the area has changed from a farming community to what it is today.

Sara-Jane Morris

Welcome speech and explanation of her role and the purpose of these meetings.

Get yourselves registered on the Padrón and Residency papers in order.

Use original source for information about Brexit (Brits in Spain FB group), Gov.co.uk search Brexit and you’ll find all the bits relating to citizens rights.

Accord so far (we don’t say agreement)

Reciprocal health care.
Maintain EHIC.
Working and paying into Spanish system, Spain pays your health care.
Pensions continue to be index linked
Residency rights will continue if currently resident in Spain.
Freedom of movement is still in negotiation.

Further info can be found at www.gov.co.uk including info on driving licences etc. This site will be continually updated, especially after Brexit has taken place.

Brits in Spain FB group - where you can leave comments (polite ones please) and PM your queries.

Richard Hill is introducing BREXPATS in Spain to the meeting and explaining our purpose and aims.

Q&A session

Legal ExPats living in Spain, what documentation will they need for travelling?

SJM - Nothing required for travel to UK - only normal passport. It will most probably be a mutual agreement between UK and Spain. Still to be agreed.

RH - common sense must prevail

Health care. Legal but no pension. Have to work in UK two weeks in every six. Where do I stand? Taxed in UK.

SJM - you need to get professional advise as this is a complicated status. Ignacio will speak to the questioner after the meeting.

Acquired rights?

Ignacio - while resident in Spain you follow Spanish law. Citizenship is important. Basically this point is still to be agreed.

SJM - Spain is a contribution system - you pay in, you can get out. UK is residency system - you live there, you’re entitled.

S1 form, reciprocal health care. What if you are permanent resident in Spain now but you reach retirement age after Brexit

SJM - you will still enjoy the same rights if we hadn’t left the EU.

Only EU countries will accept EHIC after Brexit?

SJM - living in Spain you should have Spanish EHIC which will-still be honoured in UK. The medical bill will be paid by the issuing country of your EHIC card.

Early retirees paying private health care. After 5 year resident in Spain are we entitled to Spanish Health care?

SJM - when you reach retirement age you will be entitled to S1

RTH - sin recursos is available to people earning less than a certain income per annum.

Permanent residency after March 2019?

SJM - if you’re registered in Spain prior to Brexit you will be entitled to permanent residency.

RTH - you MUST be legal in Spain prior to Brexit.

Fuel Allowance... 30 percent down on pension due to exchange rates?

SJM - non exportable benefit and more than likely won’t change. Exchange rate is out of the governments hands.

SIP issued by Valencia. Can I use it throughout Spain?

RTH - yes, it’s valid throughout Spain.

Double-tax agreement?

SJM - bilateral agreement. Double declaration but you don’t pay tax twice. Speak to a Gestor. This is not to do with Brexit, it’s an agreement between UK and Spain.

One of the owners on our community wondered if I could ask a question at the meeting on Monday but unfortunately as I was unable to attend, I asked Councillor Derek Monks:

"How does Brexit affect the rights of UK citizens that bought Spanish property before the vote but still reside in the UK? Do we have the same right to come to Spain before and after Brexit as a result of already being owners? Or, do we have the same rights after as anyone else irrespective of whether they own Spanish property now, buy a property before or after Brexit?"

Derek kindly sent me the following reply:

"The topic of citizen rights refers to the status of where people live. It concerns British people living in EU countries, such as Spain, or Europeans living in the United Kingdom. This has nothing to do with property.

Therefore, if you continue to live in the UK, own a property here, come and go, nothing should change for you.

Should you decide to live in Spain, then it will depend on the rules following Brexit, which we have no news about as yet. Those choosing to live in Spain before Brexit will likely have similar rights to those already here."
