90 day rule?

I've just read the following post on FB; fully appreciate you can't believe all you read, but is this ever right? I thought the ruling had yet to be agreed.
New Passport Barriers and Controls at Alicante airport .. in place for Brexit for inbound UK and non Schengan countries. Husband asked tonight and was told that all passports will be recorded and date stamped digitally to impose 90 day rule. It's starting .. was same at Bologna airport last month . S*** - so we'll only be allowed to stay 90 days in future and have to return for 90 days before being allowed to go again for 90 days - this is S*** especially for youngsters - Dont like it March in London atPeoples Vote UKon saturday and show this rabble in charge you dont want to lose your rights.

There has always been a 90 day rule.
If you are planning to stay for more than 90 days in any one stay then you should register as an “alien”.
If you stay for more than 6 months out of any 12 month period then you should register as a resident.

I’m surprised that Spain hasn’t cracked down on this before. Maybe it’s been prompted by Brexit, maybe not.

Would the 90 day rule apply to Irish passport holders flying in via the UK?

The 90 day rule has always been in place, but does not seem to have fully imposed by Spain. This is something that might change, irrespective of Brexit! So if you want to live here then best to get a residence card.

All EU passport holders rules apply the same.

If coming from another schengen country, then no check required.

just thought could you go to Giberalter for a night and return for a further 90 days just a idea. is this possible.

At the moment there is no problem. You are supposed to sign on the register of foreign EU citizens resident in Spain but there is no problem if you stay longer. I've never heard of anyone being kicked out after 90 days.

On leaving the EU I also doubt if the 90 day rule will be adhered to and stays up to 6 months will be allowed
However, (always an however, isn't there) if we have to apply for a Schengen visa (which I doubt as many countries don't need visas) then it is 90 days in any 6 month period so nipping across to Gibraltar for the day won't count.
The 90 day visa can be obtained twice a year but there must be 90 days in between each visit.

Bit of a nothing argument, though. Americans, Canadians, most S American countries, Australians, New Zealander and Japanese plus loads of others (62 countries in all outside the EU) don't need a visa at all to enter an EU country for up to 90 days so I can't imagine they would apply one for the Brits, especially in Spain.

There's also the bit that the press have been pushing about pensioners not being able to access their pensions. This applies to annuities coming from and insurance company that has no EU licence to trade whereas many do and those that don't are going to apply if no deal happens. However (lots of these howevers) It will depend on the country they live in. For example France, Spain and Luxembourg have already said independently that UK firms can pay pensions to existing customers living there.

Still, we like worrying about things, don't we.

Perhaps it’s scaremongering to stop the brexit issue ,simply because if it works and the whole of Europe see it then the whole of the EU would follow and Brussels would be in the pervable , lots of big paying jobs and bureaucracy finished
