As my mother was from Eire, I asked the Irish Passport office and was told even though I was born in England as, my mother was Irish I am automatically an Irish citizen and therefore can apply for an Irish Passport, so dual nationality, Not sure now if I should pursue this if Spain won’t accept it?

It's not that Spain won't accept it , it is nothing really at all to do with Spain except if you are wanting them to amend their official records. The original posted problem was that the person had already got NIE numbers using their British Passports and NIE numbers are allocated for life. So the NIE records show them as British . But they wanted to change that to having the NIE numbers reflecting them being Irish. Now that's clearly a bureaucratic problem, that must be possible of being achieved but might take a bit of time and effort and probably needing to involve the Irish Consulate and more expert legal advice than the original solicitor since that solicitor had never dealt with that situation before and clearly didn't understand the issue.

However IF you are starting out on the paperwork trail and haven't yet gone for your NIE etc there is no issue at all, you just use your Irish passport .

Indeed it would be very interesting if the friends of Mac3Blade ( the OP) contacted the Irish Consulate and told them of the problem. I am pretty sure the Consulate would help sort it out and raise the matter with the Spanish authorities. They may well not be the only people who are confronting this issue because of Brexit.

Just picked up a thread on this topic from another forum. Someone has just proceeded using new passport for new business and it hasn't mattered:

I let my UK passport lapse. I have Irish nationality too. I just made an application to renew my EU Registration (green card) using my Irish PP. No problem. New card, with existing NIE was issued

I wil ask at police station this morning if same would apply to just an NIE certificate

PS Just confirmed what I posted was correct, and you of course keep the NIE you had

I'm a bit confused, I thought the good friday agreement was Hot cross buns on friday, but no easter eggs until the sunday. Or were my parents lying to me all the time. :(

I would but I'm not on duel fuel. My electric and gas seem to get on fine together.

Okay, so if my friends do manage to change to Irish citizenship, will that have any effect on their medical rights? At present, they, being pensioners are able to access reciprocal medical care but is this reciprocal agreement also available from the Republic of Ireland. Many people assume that every country in the E.U. Offers this arrangement but I am led to believe that it is only the U.K that does....look forward to being corrected!
Forgive my initial spelling mistake, I will blame predicted text. It was a “duel” of a mistake!

The S1 form is valid throughout Europe. It's an EU directive.
However, for pensioners, the country that pays your pension is the one that also pays your healthcare and issues you your EHIC card. If you have dual nationality but haven't paid into the system of one country then I doubt they would pay for your healthcare.

Those actually from Ireland will receive the payments for their healthcare paid for by the HSE Ireland whereas those from UK will have their healthcare paid for by the NHS.

Something to look into as the dual nationality bit will help on the freedom of movement, work without a work permit etc but I very much doubt it would help on the healthcare side as one wouldn't have paid into the NI (or equivalent) system in the country.

So saying, those of us with permanent residency here as UK citizens resident in Spain may not see any change at all if the reciprocal agreements continue (settled status for EU citizens in UK, permanent residency for UK citizens in the EU).
One of those things we'll just have to wait and see.
(As an aside, EU citizens have already been told they may not get settled status in UK if they don't apply for it as it's not automatic. I would think permanent residency in the EU would be the same so apply for it, both systems say you need 5 years continuous residency and I have my appointment for it at the end of May).
