My partner and I have been resients in Spain since 2019 and have our green credit card sized residencia card.

A couple of questions that I have are:

Do we need to actively renew the residencia to become permanent residents or does it just happen after 5 years?

My gestor has just said this 'as you stopped being European citizens you should exchange your European residencia card for a Non-European one. There is a transition period which will run out on the 30th of June.'

Does anyone know if this is correct?

It is most definitely not correct, your green residents card is still current and you need not exchange it for a TIE. You automatically become a permanent resident 5 years from the date of issue of the green card, and do not need to change it ever. If you look on the UK Embassy website, you will see an official message to this effect.

However, people who have been travelling during covid restrictions have come accross border officials who are insisting that you have a TIE rather than the green card. Although this is completely wrong it is not the sort of thing you need to argue about after a tiring journey.

The advice from both the Spanish Government and the UK Consulate is to exchange your green card for a TIE sooner rather than later.

There may well be a time when it will be compulsory to exchange, not at the moment though.

It is also worth bearing in mind that if you exchange your card for a TIE, at the moment, special mention is made on the TIE as to your rights under the withdrawal aggreement. There is no reason for this to change, but who knows what the future may hold.

It is a very easy excercise to exchange your card for a TIE and need not cost more than 12€ to do so.

So to repeat, there is no need to exchange your card. IMHO, though, it is not a bad idea to do so.

Thank you so much much. I thought it was strange that they said that to me. I really appreciate all the information you've given me.

We will definitely now exchange our cards for Tie as soon as we can get an appointment.

Appointments seem fairly easy to get now they've opened up more offices. I find Alicante easy it's not right in the city centre and dead easy to get to, if you've a car of course. As said doing it yourself 12 euros each plus petrol or 60 euros for somebody to fill the forms in, get appointment and take you there.

Hi you can now go to Torrevieja police station as far as I am aware
