Hi we sold our home in Spain at a loss but had to pay the 3% tax has anyone managed to claim this back on there own please?

Settle down for a long wait. The "average" time for getting the amount back is a year but some people have waited up to 2 years to get it.

Now, at one time there was a special form to claim this back, the Modelo 212. This changed in the last couple of years and now you have to submit your non-residents tax return on a Modelo 210 (which you complete each year) and claim the tax back on that. If you post it in to the tax office it will probably sit in someone's in tray for a year or so. In which case, you can submit the 210 on the Agencia Tributaria website. At least that way you will know it has actually been submitted.

I think the rules are that you should get any money due back within a maximum of six months. Any longer than that and they are supposed to pay you interest.

When we sold a flat, it took almost 3 years to get the money back as we were non residents at the time. The sum was 1800 euros (I know, not a lot) and we got 25 euro interest after all that time.

If you go through a solicitor to claim it you will, of course, have to pay the solicitor to do it, probably in the region of 10 to 15% of the money due back. Also make sure the bank account you want the money paid into actually exists. If you have changed your bank account, make sure you tell the solicitors. Ours put down our old non resident account number but the bank changed it to a resident account with a different number. Hacienda will make one attempt to pay it and, if the account doesn't exist, will not contact anyone, you or your solicitor, and then forget about it.

(You may get the impression I am not a fan of Spanish bureaucracy, especially when it comes to the tax office. You'd be right).

Ours took 8 months through our solicitor. We had it paid directly into our UK bank. That was in January this year.

Our solicitor did ours at the time of sale. As long as you have paid all your bills and non resident tax it should go through quite quickly. Ours went into the bank 6 months to the day after completing the sale.

Good morning all, very interesting reading your experience on this subject. We brought and sold our villa through Sun Lawyers, sold September 2019. They told us it will take between 8 to 12 months to receive our 3% back, to our surprise we only had to wait 14 weeks for our money be paid directly into our UK bank account. A nice happy surprise. What makes you think you have a refund due ,were all the taxes fully paid ,did you pay the townhall tax
