Legalities of E Cycles.

Legalities of E Cycles.

Postby Barry Cooper » Tue Jul 16, 2019 10:29 am

My Brother in Law is planning to ship an E Bike over from the UK,I've been told unofficially that because it has a throttle it's illegal in Spain. Would welcome any advice on this or where to get an official decision. TIA.

So, here we go again with elf and safety and politicians that are determined to prevent ordinary decent people from enjoying life by imposing restrictions, laws and costs, just in case! My partner and I invested a decent amount of money on the 2 e bikes as shown in the photos. Brilliant to throw in the back of the car and travel round Spain, get them out and see more of this beautiful country. Not any more! Will need ITV registration, motorcycle helmets, not bicycle helmets, moped licence, compulsory insurance etc just because we can't peddle them and they have a throttle. We used to love poodling along promenades, parks and cycle lanes etc and as we are in our 60's we are not speed merchants and very aware of what we are doing. Now we will be confined to the dangerous roads, not allowed on bike lanes and look right plonkers wearing motorcyle helmets. We also have 2 standard pedal assisted normal bikes but they do not come under these new restrictions but they can go faster! Crazy!

It wouldnt be necessary if people were responsible and considerate but they aren't. You should have insurance? Wear helmets etc. Next step mobility scooters

Yes, insurance I would be quite happy with and cycle helmets also, but somebody i.e. the EU has designated these as Mopeds, i.e. Motorised vehicles so they will be classed as such for registration, number plates, ITV tests, crash helmet etc. These bikes are tiny and certainly not safe with such small wheels to ride on pot holed roads jostling with trucks and such like. Agreed the youngsters zooming around the footpaths on electric scooters as we have witnessed in Valencia recently are a pain, but it is a shame that this minority has once again affected normal responsible people just trying to enjoy the rest of their lives in the fresh air and sunshine.

I do not believe that those mini bikes of yours will come under the new law as the motor has to be of a certain power rating I would suggest a good read through the regs

Hi to all above all i can say is the best of luck to you all as im not so good on my legs & bought myself a 3 wheeled Mobility scooter with 2 seats & a 500 watt motor its the beez knees & has brakes lights horn indicaters etc. I tried to get it insured only to be told by my local Spanish insurance brokers that as it was a Mobility Scooter it could not be insured but if i added it to my household policy that would be covered under 3rd party liability so i did that. Then all the blurb came out about the new Secret Laws that no one knows anything about as wanting to keep myself legal i tried Disability Spain to see if they could clarify things for me they tried but after 2 weeks could not find anything out. I then tried N332 who did reply asking me for a copy of the owners certificate & a photo of the scooter i supplied all of that & a direct link to the company in the UK that sells them that was nearly 3 weeks ago & despite asking on there Facebook page ive had no reply whatsover from them ive even tried to remind them that i would like an answer but to no avail.
ive now tried the Spanish Citizens advice helpline & im waiting on an answer. My thoughts are the way things are going everyone with a mobility scooter will need to have a Blue Badge but as it can take from 3/6 months to get checked out at the test centre in Rojales & a further wait for you to see a Surgeon i can only see the queus getting longer & longer with everyone who does not need a blue bafge having to get one to be legal. Jpeg like you & others ive read through the laws but there very ambiguos with lots of areas not answered or talked about? My understanding of the laws as they stand is if your scooter is under 120 kg in weight & the electric motor is less than 1000 watt & it has brakes lights & indicators then its legal. It states on the sales info that these Scooters are built to EU certification & are legal to be driven on roads & pavements in the Uk restricted to 4MPH & on the road restricted to 8MPH & in Europe there restricted to 12 KPH on the pavement & 25 KPH on the road. We hope someone can come up with a proper Legal Answer?

Maybe ask at a police station as they are the ones who I presume would fine you? Would it be Traffico?

The new Mobility Scooter laws have not been decided yet I believe they are being studied bt the Government at the moment but regions can implement there own Bylaws to control them .
