A aquantance of mine lives in France for around 8 months of the year. He drove his uk registered car there and it was there with him for about 6 months until.he was stopped for speeding (55kph in a 50 kph zone).
Police made checks on his documents. They told him that as the car had been out of the UK in excess of the 90 days allowed on his insurance, it was seized until he could provide them with a French insurance certificate. Plus a big fine and much expense.

I have a Spanish registered and insured vehicle now, just in case I overstay the 90 day period in my UK car. Not going to take a chance driving through France!!

I have a Spanish registered motorbike which I use when I am here (I am NOT resident in Spain). Although I have recently ridden it in France and Portugal, I believe I cannot ride it in the UK as I am not resident.

French police are having a real clampdown on speeding and other traffic law infringements. They issue fines by post to the owners of UK registered vehicles caught breaking their laws, as it is the owner of the car that is responsible, and NOT the driver (is this the same in Spain?). So drivers of foreign registered cars in the UK aren't pursued by UK police as UK law states it's the driver, not the owner, who has to be the subject of the fine, so they don't bother. So speed camera and red light offences are rarely, if ever, pursued.

As an example, many of the Romanian* registered RHD cars seen in the UK have never left the UK. Just a letter to a "friend of a friend" in your home town to say you own a new car will get it registered there, and a set of Romanian number plates and log book will be posted out to you shortly after.

(* other EU countries also catered for in the same vein).

I would imagine that the current EU rules also apply to France....quote "A UK registered vehicle can (currently) stay in Spain for up to 12 months..... as long as the owner remains a UK resident and the vehicle is street legal in the UK (tax, MOT & insurance). It's the owner that has to leave Spain before 30 days and not become Spanish resident, intentionally or otherwise. It looks like the problem is that your friend has (unknowingly?) become a French resident by staying over the 3 months allowed and he/she will probably find that they have also become tax resident in France.
