Closing Communal Pool

Has anyone been in a situation where some owners don't use or want the communal pool? Do you know the property law that applies? Can a vote be taken to close it completely? If so, does it require unanimity or just a majority? What happens if it stays open because of a minority, but the majority won't pass the budget to maintain it? What if it then becomes dilapidated or unsafe? These are a random list of thoughts and questions, but a friend of ours seems to be in this situation. Many fellow owners in the community have their own pools, the cleaner has been hopeless, the pool area is deteriorating and there seems to be a move to close it altogether rather than employ a reputable maintenance company and pay for repairs etc.

I think the only people who can give you the answers to those questions are the administrators who will have the correct answers.

Allowing the pool to deteriorate or close may well affect the house prices in the community. Maintenance is compulsory. Hopefully your Administrator is also a lawyer to advise on your questions.

They don't really trust the administrators, partly because they have allowed the situation to deteriorate without taking any action. So I'm asking for information from people who may have experienced a similar situation, if indeed there are any. The house price issue is one consequence, but they want to know where they stand before attending a community meeting on the subject. If a majority can vote to abandon the pool then there are all sorts of issues, but if possible they would like to know the law on this. My reading online suggests a three fifths majority can decide, but it doesn't specifically mention pools (although lifts are mentioned which are at least as important).

An the president at least throw a couple of pots of chlorine Into it, that will start to clean it, some of the residents clean it, at least it won't be a breeding ground for mossies. The sooner you find out what your options are the better you don't want some child falling into it like that, the community may get done for all sorts.

The pool has recently been emptied and the gate is locked so children shouldn't be getting in. Basically it's out of action with a meeting soon which may result in it being abandoned altogether. Thus my question(s) as my friends don't have their own pool and want it maintained properly and regrouted etc to make it safe and usable. I don't even think they currently have an active President due to ill health and returning to his home country. It's a mess I know.

Would your friend put himself forward as president? It's a horrible job. Good it's empty. How many houses on the Urb? Do many live there?

Sorry I don't really know any of that. Smallish community of mainly detached second homes I think. As far as I know, if there was no pool there would be no other communal facilities to preside over anyway. If the pool remains then my friends would probably be more interested in the job than anyone else, but they are non-residents themselves so only here a few times each year.
