Dividing Walls

I own a property in Rojales Hills, my neighbours property is slightly higher than mine, he has raised our dividing wall to 3m on our side he’s has raised the dividing wall without any discussion our agreement with me i think dividing walls are supposed to be 1.8m.

Does any body know what the rules and regulations are regarding my dilemma and what I am permitted to do regarding this. Our community have said it’s nothing to do with them.

Hi. Last year I had reason to go to an Architect regarding works at my home and asked the same question. He said no higher than 2m on my side which would have made the neighbours side 3m. Hope this helps.

I did discuss it, but didn't obtain anything in writing, I gave a few options stating that should they want the most expensive one they would need to contribute, but they didn't offer so went for what looked best from my side.

It should be covered in the community Standing orders so I'd ask your president again. On our community its a max of 1.8m including any balustrades

I'm not on a community, My dividing wall with the neighbor was 1.8 m to top of balustrade but the biggest problem was that the coping stone's, tableing and several of the balustrades had "blown" In the 5 years we have lived here I have patched and painted them twice, but they would never be right as the reinforcing bars had rusted and popped. Unfortunately my neighbor really care what they look like, probably because the balustrades were above their head height. When I approached them I explained the situation, with options, 1 Remove them and build up wall, 2 replace with aluminum panels, 3 replace them with glass panels. They said glass would be nice, but when I asked for a contribution because of the cost they said "don't bother just build it up. It looks fine at my side, but not great for them. Glass was going to cost me 4.500 E I only asked for 1.000E

Sorry you mentioned community in your post so I assumed you live on one. You could ask at the Town Hall as I've a feeling the 1.8m limit just may be part of what is known here as the Horizontal Property Law which applies to everyone not just communities

I thought that walls were owned 50-50 between neighbours. When I had a shed built against my party wall, the builder would only build up at half the walls thickness because of this ownership issue

My dividing wall was 1.8m on my side, with our properties being on a slope my neighbour is slightly higher he has raised the wall to 3m on my side I don’t know what the height is on their side.
Does anybody if the are any regulations on heights of dividing walls where on neighbour is lower that the other ?

Hi Ron, I didn't mention "community" that was the OP, but I'm sure your right about the Property law, The architect I spoke to said the permitted height was raised to 2m a few years ago. We stopped at 1.6 at one end and 1.9 other end.
