Squatters

Hi looking for some help and information.
1of the properties in our community where the resident has passed away and the property has now got squatters, within the past 24hrs. Guardia local spoke to the squatters and said they couldn’t do anything. No family so can’t denouncia them .
Looking for help are there any other options.

Hello,

there have been several pots on this issue, the police will do nothing after 24hrs.
I am not able to input the company to sort this out for you, pm me, if it is moderated.

This is the company to resolve your problem Desokupa.com (Daniel Esteve), as you will see they are well equipped to sort this situation out.
I would not hesitate to you this kind of out fit if this happens to me, let me know if you instruct them.

We have got exactly the same problem. My neighbour called me late one night, 10 mins past midnight saying somebody was breaking in above her. I went over and the man was fixing the lock where they had broken it. I said you don't live here, you've broken in, I'm calling the police, they said call the police, which I did. They eventually arrived, the squatters showed them the rental agreement and the police said nothing they can do. Now the owner had died 4 years previously, nobody has made a rental agreement but the police don't check it out. They have no water or electric but steal it, it's been proven, they apologised offered to pay the neighbour and now, Thursday the other neighbour arrived for their holiday and realised no water, when they looked in the water cupboard the pipes had been switched over so the squatters were using their water. The police were called but they said you need to call the water board first. The waterboard came and changed it but squatters still there. We also had some just up the road, the English owners arrived, pulled up outside and noticed the lights were on, thought they'd parked outside the wrong house, anyway knocked on the door and told no we live here we are renting, police called, nothing they could do as they had a bogus rental agreement, the police helped by getting the owners a hotel for the night!! It's taken 2 years to get them out, a lot of stress, the poor woman lost 2 stone and a lot of money going through the courts. Dont know what's going to happen with the ones we have as the owner is dead and the son, according to the grapevine doesn't want the apartment. I often see the group Despoku or whatever they are called and they seem to resolve the problems. I did contact them and I think it's around 3k for their assistance but would think it would have to be the owner who owns the house who are the only ones who could decide to use them. Talk to your administrator's and tell the neighbours to check their water and electric.

Thanks for the replies. It seems there is not an easy solution and the police aren’t really bothered it seems.

Apparently the ones we have are very quiet from what the neighbours say and they have seen the house inside when the doors open are they have new furniture as the old lady had dark old furniture and this is brighter looking, they say it looks immaculate inside but the only thing I don't like is the using of the pool and the stealing of utilities from other people. There's nobody to denounce them that's the problem, only the neighbours who have had water and electric stolen, don't know if that helps getting them out.

It's an utter joke. We had similar...Eastern European squatters came in and took over a place where the owner had died and the iwner's family couldnt be contacted.

Police came, and were shown a bogus rental agreement.

Administrators were completely useless...all you get is "The police can't do anything - it's the law.".

"Show us this apparent law", we say to the Administrators...and are met with a shrug of the shoulders.

The "law" appears to be Article 47 of the BOE. Thing is - that Article specifically relates to SPANIARDS..."All Spaniards are entitled to decent and adequate housing.".

Spaniards...NOT random Eastern European gang members, British, Australian, or any other nationality...

Ultimately, the squatters were removed by one of the Desokupas companies...but not until they'd pretty much bled the community dry with scaremongering and sales of alarms.

The whole thing is a racket.

The squatters have more rights than the owners, it's completely and utterly wrong. Plus the English couple who turned up and found their home occupied had to continue paying the water and electric, it's against the law to cut it off. Both lots of squatters work and have decent cars, of course they do, they're not paying for anything! The squatters on our urb have no water or electric of their own as obviously it was cut off before they moved in due to the ladies death and non payment I presume. The law needs to be changed to protect the home owners. So many people say if that happened to me, I'd have them out, I'd get the boys in, don't think they realise what kind of trouble they'd get into if they did.

But (alluding to my post above), which "law" is it that needs to be changed, Chris???

The Spanish law on this issue is unfathomable. It’s pure common sense, but the Spanish courts don’t appear to have any.
