Touristic licence question...

We're shortly to complete on a property and ideally would like to rent it out to holidaymakers when we're not using it. My understanding is that we'll need a touristic licence but our solicitor says that present, approval could take several months.
I had read somewhere (not sure where) that it is OK to rent a property out once the application for the touristic licence has been submitted. Is this still the case? We're wondering if it may just be too much hassle for a very modest gain.
Anyone had experience / knowledge they'd like to share?

You will not be allowed to advertise without the licence number, ours took well over 12 Months to arrive, you also need to register guests with the Guardia.

And be sure about the attitude of the municipality you come under... I have gathered from the forum that some municipalities, specifically Benijofar, I don't know about others, are not keen on granting tourist accommodation licences...ergo, if you bought a property in such a municipality thinking you could do tourist short term lets... well, you won't be able to...

We applied for tourist licence 4yrs ago, last year they sent us an email saying licence was still in the process, told them to forget it as we now live here, 3yrs for a licence?? Still never got a mt €170 refund

We applied in May 2018 immediately we bought our rental house in the Orihuela Costa region. We finally got the licence in June of 2021. It took 3 years and 1 month! Be prepared for a long wait. You definitely cannot rent the property out until you have the licence number. Police are currently cracking down on unlicensed lets in many areas of Spain right now, and fines are hefty at between 20,000 and 40,000 Euros.

Areas have percentage which can be rented out for tourist purposes. Obviously this is going to affect many in this area with so many rentals around. Doesn't apply if you rent long term, though.
Still many being rented out without the licence, though. At least 3 near me have been rented to short term without a licence. Hope they don't get caught and our administrators are saying we should report those doing so, not that I'm going to. Unless a really obnoxious lot come in next door with the brats...probably not even then.#

Hi we used merry maids to gain our tourist licence. Took less than a year to get give them a ring or email.

Hi upstream,
Before you an apply for the Tourist Licence, you need to obtain a "Certificate of Compatibility" from the relevant Town Hall. Without it, you cannot apply for the licence. Many estate agents will tell you that you can rent out a property, but all they're interested in is selling it. In some areas, Town Halls have decided a blanket ban on tourist licences. In others, the certificate may be available, but the property you're proposing to buy may not meet its requirements, e.g. the bathroom/s may be too small. If being able to rent out your property is a deal-breaker, check with the Town Hall before you buy.
