There was a court case in 2014 i think where the president was charged with denying access the judge threw the case out as a pool is a luxury and has to be paid for, you don't pay you don't use.

We have an apartment in Algorfa - pool is accessed by a key fob and if fees not paid fob is blocked (or so I am told). However when I was sent a copy of the minutes taken from last Annual Meeting was totally shocked to see some people owed in excess of 4k ...would not happen in Uk Bailiffs would be in !!!!

The court case I saw the judge found for the owner

I do not think any judge would expect a president of an urbanisation to be an expert in Spanish law. That would be nonsense.

Presidents have administrators to go to for advice on any, and all, matters.

If the president went to the administrator to ask for advice on a matter, such as keys and pools and acts on that advice I cannot see any judge in the land penalising the president..

No matter what some would have us believe, the Spanish are not idiots..

We have long term renters who have been denied pool access because the owners haven't paid but they just ask whoever is in the pool to let them in or give them their personal no which they do, so annoying!

Just to say I do feel sorry for them particularly if they have children but overall fees owing are in the thousands and the owners are still getting their money.

What about the utility bills. Are they paying that? If through a standing order, they can be traced. I was particularly referring to the case of the person who said he lives in a camper van.

Good morning to all
Just reading the comments on none community payers my wife & I had an apartment in Tenerife for 11 yrs only sold out last December have just bought on Benimar 11 we had the same problem out in Tenerife when the Aministrator finely got some none payers into court who had not paid anything from the day they bought ( some as long as 10yrs ) the court could only order them to pay the last 4 yrs so they still benefit by getting away with 6 yrs none payments. I don't know what the rules are in mainland Spain regarding this .

Unfortunately by law you are not able to prevent a non payer from using community facilities, however frustrating this may be, equally on my own community we have had a persistent non payer for fifteen years, legal proceedings have been taken against her, and all she does is pay a percentage of what she owes (thousands) to avoid the court, then starts with the non payment again, so we go around in circles, the whole procedure is very difficult and expensive.

Maybe the way round this is to set the community fees at say 1000 euros per month if the fees were 50 euros(exaple only) with a discount of 950 euros for paymen on time then any non payers would amass a massive debt of 12000 per year when taken to court if they did not pay they could end up with a bill biger than the annual fee, any non payers on our community are levied with a percentage fine not that this would help if they were repeat long paying offenders.
