Making a will in Spain

Hi All
My husband and I own a property in Quesada and need advice on making a will so that in the event of our death ,our children ,who are adults and live in the UK,aren't left with a headache!! What are the procedures?

Very good and come with you as a translator if required.

Normally the lawyer you used to make the purchase of your house would do one for you, so best to check with them in case you already have that included in the fees of your purchase. If not then there's lots of options, but it's always best to use a good, fully qualified lawyer, rather than just one of the many "will-makers". Yes, they're a few euros cheaper, but they're not qualified to give you advice and will simply prepare a will as you tell them. But there's a lot foci sidetracking when making a will and getting advice from a lawyer at the time may just make the difference when it comes to your family having to use the will.
I had my will done at the time of buying my house using my solicitor Silvia Galve Marti from SGM Solicitors on tre Main Street of Benijofar. She's great and gave so much advice to me and I now have peace of mind that if anything happens to me, my family will have as little hassle as possible. So there's lots to think about and plenty of options but the most important thing is making a will in the first place. Good luck :)

avda de las naciones 11 quesada

2 wills £150 euros each inluding notary fees & the will itself printed

don't forget to put the clause in................to be done under UK law

there is a big difference to the outcome !

Guys,
Go direct to the notario...if you don't speak Spanish the ones in Rojales do and it will cost you 60-80 euros.

Yes true, the notary is the cheapest option, but they will just prepare what you tell them to. Again, when I did mine, I though it better to pay a little more to a lawyer and get their professional advice and I'm sure it was a good decision. I changed several things after her advice. But if you just want the cheapest option the the notary will do a will for you, no problem.

Hi Rosie, we made our first will in 2004 with a lawer in Gandia. In 2013 we bought a property in Quesada hence we had to make a second will which included our new house here and our apartment in Tavernes de la Valldigna, again using a lawer in Quesada. I have been informed from a friend that in September of this year we need to include a further two sentences. I do not know what these inclusions are yet. I would strongly advise speaking to a lawer.
We are Scots and our children stay in Scotland so if you are from the "motherland" make sure that the part partaining to affairs back home have are mentioned and covered under Scots Law, there are several differences between English laws and Scots laws.
Other things you may consider are funeral plans, we both have funeral plans with Avalon who will liase with Gurdia Civil and other parties viz. Corenor. Avalon policies cover both Spain and UK. Reps for this company can be found at the Sunday market at Zoco.

Hi, Can you tell me where in Rojales the English speaking Notary is? :?:

I used a very popular & well known Soliciter in Quesada a few years ago & had wills drawn up (expensive) i thought) then earlier this year they contacted me about our wills, & i was told a new Clause must be added!!! Cost to be not much difference than new wills!!!

I am hoping that a Notary can simply add the clause which i believe is "to be done under uk law" for less than a complete new will charge for both of us.

Thank you all for your replies , v useful information . We use our property a few times each year and wish to get will sorted on our next visit to Spain .
1 Is it true a copy of this will should be made available to our uk solicitor ?
2 What are the financial implications for our children ie taxes ? Can one child or all have to be named in wil ?
