Spanish resident inheriting from relative in UK

Spanish resident inheriting from relative in UK

Postby Singer » Wed Apr 04, 2018 3:41 pm

Has anyone any actual experience of a situation, reasonably recently, where a relative, a UK resident, died in the UK and left some money to a Spanish resident living in Spain.

I have tried to find out about this (is Inheritance tax due, or not, and so on) but am getting conflicting advice from local solicitors. Some have said there is nothing to do, no tax to pay, others say differently.

I realise the stock answer is to see a solicitor, but in the light of the above I would be very interested to know of anyone's experience.

Thanks in advance

Yes, there is inheritance tax to pay but it will all depend on the relationship to the deceased.
Children get an allowance of €100,000 then a 50% reduction on the tax due (was 95%).
Allowances vary greatly and it is declared on your tax return the year after you receive the inheritance.
Your solicitor or gestor who does your tax return will know the various grades of relationship and the allowances given. Each region has a different allowance so living in the Valencia Region is far higher than Murcia, for example, and you will be given the allowance applicable in the region you are resident in.
Note that if you look on line for advice, the allowances were changed in 2014 and applicable from 2015 so older posts will not longer apply.

Thanks Marcliff for your very detailed reply.

I don't know whether you have actually experienced this yourself, in recent years, but what you write fits in exactly with one solicitor's view on this. The others hedged a bit and shrugged a lot.

I do appreciate your answer, so thanks again.

I'm going through it myself now. My mother died the year before last and the estate was probated last year so I have to declare it on my tax return this year for 2017. As the amount was less than 100,000 euro (there were three of us who inherited) I have no tax to pay.

Almost identical situation to myself. To be clear, I take it that your mother was indeed a UK resident? You must have a good solicitor, too.
