Help with moving after Brexit
Help with moving after Brexit
by jorel » Tue Sep 13, 2022 9:14 am
Hi everyone just a shot in the dark here. I am a pensioner and a temp resident in Spain. I have free healthcare thanks to the S1 form.
My other half wishes us to move to live in Germany next year to be closer to her daughter (lucky me) only joking.
I lived in Germany in the 70's and 80's as I was in the military and I know it was a different life but I would like to return there and see things that I never had time to see then.
I am busy searching for answers on the use of the S1 form after Brexit. I still think we should have stayed in but hey ho.
I am not the best person on using the internet and so far I can only find information regarding before Brexit!!
Is there anyone out there who has been in a similar situation or may know someone who has?
I did find information about pensioners moving to Spain after Brexit which was an eye opener.
One has to have a larger amount of money unlike when I first moved to Spain in 2016.
Thank you in anticipation.
John

I cant answer your S1 question but I believe your residency rights under the Brex!*t withdrawal agreement only applies to the country you were resident in at the time i.e. Spain, not other EU countries. I understand you can apply for an EU residency permit using a form EX-11 that would allow you move country.

I take it by "temp residency" you mean you have a residence permit that is under 5 years.
If you wait until the 5 years is up and become a permanent resident then you can freely move to another EU country as an EU resident.
The S1 form is valid throughout the EU so you can continue to use that but you must re-register for one from UK (they will also issue a EHIC to cover you in other countries outside the one you live in and UK).
German healthcare system is a private/public shared system and German citizens take out a basic private health policy or an more detailed one. I don't know whether this applies to pensioners but you could get advice from the German embassy.
Permanent resident status in one EU country allows you the freedom of movement within the EU 27 states and the freedom to work in any country and to reside in any one of them.
Oh, and if you think Spain loves its bureaucracy, wait until you start dealing with the various Amts in Germany.

We lived in France with full residency status for 14 years. At the end of 2021 we decided we would like to move to Spain. We contacted the Spanish Embassy and they asked for copies of our residency cards. They informed that as Britain has left the EU and is now classed as a third country and being British Passport holders you still have to apply for a NLV to move countries. We had to apply through the Paris embassy.
AS for your S1 you have to get in touch with the DWP when you have a date to move & an address, they will then cancel your existing one for Spain and issue you with a new S1 for that country.

Yes we are pensioners. We had S1 when we were in France. On moving to Spain the DWP transfered our S1 from France to Spain

Can you provide a link to that please because I think you're mixing up residency with citizenship.
