Residencia - NLV's

Residencia - NLV's

Postby apricorncup17 » Fri Jan 06, 2023 12:38 pm

Hi there folks. Just wondering if anyone else has had a similar issue to this. My wife and I moved to Costa Blanca in June 2021 with a NLV (Non Lucrative Visa) towards residency. In simple terms, you apply within 30 days in Spain to become resident (which we did) and we were issues an ID (with photo) card and after 12 months, we would then have to re-apply (as per guidelines) for a further 2 year extension & then at the end of that term, a further 2 year extension (making 5 in total) to fulfil the residencia t's and c's. We have been waiting and waiting and waiting, since July 2022 for another appointment, but due to a variety of reasons, one of them being the war in Ukraine (according to our gestor) we have been unable up to this point. to get a further appointment. Now our gestor says, that he has spoken to the police & whilst I do not have the full facts at the moment as to why, he is suggesting that we return to the UK to get another NLV, which sounds prepostorous to me, as we do not have a home there anymore or any family there, plus there is all the potential expense and hassle. I have just qualified for my UK state pension and my wife does not get hers for another 3 years. When we applied for our residencia in Alicante in June/July 2021, we were told by our gestor that we should have around 33k in our bank account for around 3 months & then after this time "it is your money" so the inference was that we were not reliant on the Spanish state. Since this time, we have purchased a house, a car and both have private medical insurance, so we are NOT incumbent on the State to support us, so I am at a bit of a losss what to make of this, but I will be speaking directly to the gestor on Monday to see what the situation is. We no longer have copious amounts of savings, so we are very prudent with our lifestyle, so my pension will be put to good use, I am sure. Can anyone suggest the best way forward. Incidentally, when we showed our Gestor our visa in our passports in June/July 2021, it was the first one he had seen, in fact he didn't know what it was until i explained it to him. I am hoping for a positive outcome, but as with other things here in Spain, common sense is somewhat of a rare commodity. Happy New Year and thank you.

Your gestor would appear to be incompetent. I became resident here before NLV's were introduced but there was a lot of discussion on this, and other forums, as to the conditions that would need to be met, for people like yourself, who wanted to come here, post Brexit. If I were you, I'd find someone more competent withour delay. Have a read of this link, especially the bit that that talks about financial requirements for year two.

Agree with Garysl. You need to get someone else as soon as you can. For something like this you are better off with a proper abogado than a basic gestor, who is not necessarily qualified in anything. It will be more expensive but far too important to skimp on. Go to an abogado. Try SGM , who seem to have helped a lot of people on this, they are not cheap but you need competence. Others who have gone through the process may have other good recommendations.

My wife and I have just gone through the process of applying for our Year 2/3 NLV and have done the Police fingerprint process at Alicante and am expecting to pick up our new residency cards any time now. By the sounds of it your gestor is an absolute waste of space and totally incompetent. We used Right Move in Quesada (near the arches) who have a very good relationship with the staff at Alicante and are very efficient. I initially discussed our renewal with SGM at Benijofar but their fees were nearly 4 times more expensive than those at Right Move. The only paperwork we needed to provide for our reapplication was proof of health insurance which you say you have plus proof of funds either by income such as pensions or savings. The amount required is twice the amount required for your initial 1 year NLV.

Proof of income does not mean 2x 37k in the bank!

If you can show that all well and good but it is not what's required.
