Tax return
by nigieboy » Thu May 27, 2021 10:54 am
I rent out a property in the UK.My tax is being done for me by lawyers in Benijofar who have requested that my UK tenants provide their passport details...is this usual? What if they have no passport?
I can provide bank statements with their DD but this doesn't seen sufficient .
Any help from thoss that have completed a return recently greatly appreciated

If they dont have a passport, then you have to provide their national insurance number. This is normal practice

I've just completed my income tax return and didn't have to provide any personal details for our tenants in the UK. We've had to provide passport numbers for tourist rentals in Spain in the past, but not for UK long term tenants.

I got asked the same this year by person doing my tax but said that a could not get that sort of information...and it is not asked for by my letting agents ...I think it is because you need it if you rent out here in Spain so they ask .

Your UK state pension (old age pension) is only taxable in Spain and not at all in UK, but only if you are a resident in Spain. If this is your only income that is taxable in Spain then your Spanish tax allowances should take care of it and there will be no tax to pay. Technically, after the first tax return, your income may be deemed low enough to not warrent an annual Spanish tax return. My advice is to still do one each year as this is your proof that you are a full tax paid resident in Spain and is well worth the 50€ or so that a gestor may charge for filing it each year.
As for UK rental income, we have never provided passport details or NI number for our tenants. We did once have to supply a written affidavit, from our tenants, to show that this was both a long term tenancy and to a single family, not a business. These criteria get you a very favourable treatment from Hacienda, with a godd discount on the income before tax is applied. Indeed, we have never had to pay any Spanish tax over and abouve what we paid to HMRC for the rental income.

My lawyer has reiterated the NI or passport info of my tenants ..they have asked for proof of rental income which I have provided by pdf of a bank statement...and now they want detaiks of any expenses.. which I assume are landlords insurance,Gas certificates and other maintenance.
This is the 1st time I have completed a Spanish return and I want to get it right.

Tell your lawyer you do not have consent, so you cannot legally give out their information, unless the tenants give their consent you cannot supply their details, it might be different in Spain, but that's UK law.

We weren't asked for proof of the numbers, I just provided my own summary records on a spreadsheet, but if you have a managing agent you should have monthly statements from them. I would have supplied these as proof had I been asked. If you don't then it's reasonable to be asked for source documents like bank statements, receipts and invoices. Personally I don't think the personal details of the tenants are relevant and, as I said before, we didn't have to provide this for our long-term tenants in the UK (only for tourist rentals in Spain) so it can't be obligatory.
