Apologies for bringing up this topic again…..

For the year 2021 we first entered Spain on 9th July and stayed until 19th September which was 72 days out of our allowed 90 days. We need to come back to Quesada at the end of November for 1 week which will be within our 90 days allotment. We are then booked to return on 3rd January 2022 is this permissible under the Treaty? Obviously we only stayed 79 days in total for 2021.

Yes. The fact it was 2021 doesn't come into it as it is a rolling 90 days in 180, not a calendar year.

Putting those dates into the Schengen calculator shows you can stay 83 days from 3 Jan 2022

Using the Schengen calculator you will be allowed stay until the 26th of March.

There is a slight problem with the dates but you should be OK

9 July entry to 11th September exit is actually 73 days including the entry and exit dates as "being in the EU"

Remember to count your November dates on that basis (include the entry/exit)

The 180 day period (from 9 July 2021) does not end until 5th Jan 2022 but you will be OK because the 3rd, 4th and 5th Jan 2022 (3 days) are still within the allowed count.

Going forward take your arrival date in November 2021, add 180, make sure that your Jan 2022 & subsequent stays do not take you beyond

Similarly going forward from that, it is continuously "rolling" 180 day period you must look to

Really can't believe the comment that the Schengen calendar is easy to use. If it was we wouldn't have so many questions on here.

It really depends on how u need to use it. Sure it tells you if a 1 off trip is legal/permissable but not great if you are trying to plan a series of trips over a longer period.

But the problem isn't down to the calculator it's down to the wording of Schengen agreement. Uk chose not recognise it when it came in to EU law so didn't give it proper thought. Now we are stuck with the consequences.

What I believe that Jonno means :) - is that it occurs because the UK, (rightly, correctly, as an opinion) chose not to be part of the Schengen agreement (originally in 1985) - but that is a totally different and complex subject that was given a lot of detailed thought and consideration.

Hi Jonnno, yes I accept 'easy' is a subjective term and what is easy to one may be difficult to another. I'm not sure it's the only reason we get so many similar questions on here though! What I can guarantee is that none of us who take the time to answer the Schengen queries are mathematical geniuses and we all consult our preferred calculator first. That's why I always recommend that the posters learn to use it themselves if they can.

and its probably why my day count to 5th January is one day too long! (i believe that it should really have been to the Fourth)
I didn't use the calculator properly!
It's easy to be one day out

As far as I understand the rules you are allowed up to 90 days in 180 days. This means if you were here in July and left in September You cannot come back until Jan 1. However to be on the safe side phone or email the British Consulate in Alicante. They will give you the correct details.
