Whats the law in Spain regarding


1. using a phone whilst driving?

2. using a metal detector on the beach ?

Fines for using a phone whilst driving and points off your licence but it's common sense anyway not to use one whilst driving.

I'm not sure about metal detectors

1. It is totally illegal. Even the use of bluetooth or headsets for mobile phone use is illegal. Fines of 300 euro and 3 points from your licence. They are even talking of banning hands free devices and increasing the points penalty to 6.

2. A permit is required for metal detecting anywhere although it is widely ignored. Any finds must be reported to the local police who will notify the correct authorities depending on the find. Metal detecting on beaches close to naval facilities is banned.

A metal detecting permit IS required for the whole of the Valencia region & is only being ignored mainly by tourists & those that want to risk heavy fines & confiscation of their equipment. The authorities are now clamping down on this practice and, as a fully licenced & legal detectorist, I can confirm this as I have been challenged by the Guardia Civil several times (this being on very early mornings before the beach goers are up & about). Having checked all is in order they are happy to let me continue, unlike the guy further along the beach who was escorted off to who knows where?
Unless you are resident here & can supply a bona fida address it is unlikely you will receive a permit anyway. If you are able to obtain one then there are still protected areas where you are not allowed to detect on, again risking heavy penalties if you are discovered. As usual, we all have to suffer the consequences of those few who have operated under the cover of darkness, robbing archaeological sites and leaving devastation behind them, all for their own personal gain.
In summary, the days of just turning up on holiday & wandering up & down the beach are pretty much over, sadly.
Detecting inland is also forbidden.

I asked about using phone while driving, because ive seen so many people doing it, I was starting to think it was permitted. Ive seen loads of people using phones whilst hurtling down the CV95. No one seems to take any notice of the law.

Same in the UK. It's absolute madness - What these people don't realise is if they have an accident and someone dies then they get done for manslaughter and go to prison.

In any traffic jam you can see so many on their phones and if you watch the traffic in our busy town in UK, drivers are so intent on their phones that gaps occur in the traffic as drivers don't realise the traffic is moving!!!!

There should be more warnings and adverts to show the consequences of driving while using a phone.

One taxi driver in Spain (not our usual one might I add and one we will not use again) was using his hand held and pressing buttons on his satnav as well as answering his hands free radio all the way from the airport...a scary journey!! You really wouldn't realise it was illegal!
