Hi Guys,
Before we go any further ! Yes I am a resident.
But does anybody know what the deal is for the ''under the radar'' overstayer and are people actually being deported ?
And if so, who is enforcing such action?

I've not heard of anybody being deported but I have heard of somebody who missed the deadline and is collecting their residencia next week and without having the funds required.

The Spanish gov has denied rumours in the UK press that those who have overstayed their residency will be "rounded up and deported". They have said, several times, that will not happen.
Trying to get something official done, though, may be difficult. It will be flagged up if you leave Spain and you could be denied access back to Spain depending on how long you have overstayed.
I doubt we'll see anything happen for some time until people start nipping back for doctors appointments and prescriptions etc or having to go back to UK for a family visit.
There is, however, one lot I'd like to see being sent back. Bloke mouthing it off in a bar the other night about how he hasn't got residency, has been here 5 years and still gets WFA, pension credits and gets someone in UK to collect his prescriptions and post them out to him. The same person's address that he uses for his UK bank and so on.
Now, it wouldn't normally bother me (live and let live and all that) but he kept going on and on about how stupid those with residency were and paying taxes in Spain etc. I was glad to see those around him were moving to tables further away after a while.

Not sure he’ll get his prescriptions anymore , I personally know someone that had hers kept in Madrid and returned to the U.K., she received a call from Correros saying prescriptions would no longer be delivered

Yip couldn't agree more, When we rented Torrevieja prior to buying, a young couple (English) kept boasting how he was working in a bar for drinks money. She was on benefits in Britain, the usual stuff, housing, family credit, jobseekers etc etc. All she had to do was make 1 trip per month to the UK to present herself at the job center with a list of "jobs she had applied for" and do some banking and her benefits kept coming. The kids were under school age, So no schooling required. The question is who's more at fault, them? or the UK benefit system? I often wonder what they did during all the travel restrictions. And now of course the 90 day rule.

How did Correos know they were prescriptions it is illegal to open mail even for Correos
