OFF PLAN PAY BACKS

Has anyone successfully been paid back a deposit on an un finished property, whereby the deposit was with the bank.
I have been fighting now for years and years and my case is with the court in Madrid after the high court ruling made four years ago that the banks should refund the clients money. The bank however appeals again and again even though I have won my case in three different local courts.

I would be interested to hear if anyone has won and received their rightly owed money which is in a bank escro account.

I haven't personally seen any articles recently that have caught my eye. I do remember many cases from the old Torrevieja.co.uk site which were still active. It is very hard to understand how banks can get away with this type of behaviour or why the Bank Regulator hasn't stepped in and fined them. The banks are holding people to ransom for money they don't own and can surely have no hope of getting a legal resolution favourable to them.

I agree completely, strange thing is my husbands late partner left 40,000 in a bank account here for her son who resides in the USA and half the house to which he never contributes, but the Bank Regulator has been on to us for his USA details as apparently they cannot hold onto the 40,000 any longer. Strange that!!!!

In my case the bank keeps appealing my case despite their records showing my name against the entry and as I mentioned before the high court of Madrid passed a rule that the banks holding the money and not the builder should pay the proposed purchaser especially when the original contract was illegal as in my case. Currently as an update the tribunal has my case which is now 4 years since my last win prior to appeal, but been fighting since 2007.
