ADVICE PLEASE. We are residents here and have no assetts in the uk house, cars, etc, But still have a english bank account,We have wills from a notary in Almoradi written in both Spanish and English leaving our Assetts here to be divided between our children. Is this suffice other half thinks something new has since surfaced.

I think that your best bet would be to contact the people who did your wills and they should let you know.

Hi LittleChris,

I hope the following helps and also other folks reading this also:

If you have assets in the UK of any sort, even just a bank account then you will need an appropriate UK Will to cover those. Your Spanish Will on its own cannot adequately deal or be used to cover your UK estate as the Will itself would need to have an apostille attached before it could be presented to a UK probate office for consideration and all too often even then, they are rejected if the Spanish Will is deemed not to have been executed correctly.

So, either you can organise the preparation of a Will to cover your UK estate when you are next back over in the UK or we can easily arrange this for you while you are in Spain and get it registered on the UK Will register for you.

Regarding a Spanish Will, the things to ensure when arranging this so there is no ambiguity whatsoever when the time comes are:

1. It is written with a Brussels iv clause within it (an EU succession 650/2012 succession clause). This enables you to choose the appropriate law that you wish to govern the succession of your estate in the UK.

2. With regards to that law, it should state one of the following based upon your country/jurisdiction of birth or the passport that you hold:

a). The law of England and Wales
b). The law of Scotland
c). The law of Northern Ireland
d). The law of the Isle of Man
e). The law of Jersey & Guernsey

Please note that there is no such thing as UK law or British law in generic terms.

While a lot of these matters are simple 'technicalities'' it is upon just such technicalities that legal arguments and precedents are of course set, so for me, it is always best to be 100% accurate at all times.

Yes you can get Spanish and English wills power of attorney for both countries funeral plans, all
insurances. And tie,nie driving licences at expat centre as well as a cup of tea or coffee with their in house experts.

Their estate planner will be their every morning next week and offers free Will health checks and free advice, so pop in for a cuppa and good friendly helpfully advice or call 865 66 85 96 or their website theexpatcentre.com hope this helps
