Already had NLV for 15 months, can I claim a non EU partner

I want to claim a non EU partner, get married if necessary, using my NLV.
I don't know I I need to be here for the full 5 years before claiming a non EU spouse.
Anyone know the rules or know an abacado that covers immigration law.
