Correct. You can't be charged this tax as a non fiscal resident which you become after 6 months residency. That's 6 months in any one financial year which is Jan to Dec in Spain.
We sold our house in UK in December 2010 and became residents in Spain in January 2011. We completed our first tax returns in 2012 for the year 2011 and the house sale in UK had nothing to do with the Spanish tax man.

Thanks Marcliff...you always have answers! another question driving licence again has been said that the uk one must be changed to spanish before 31st December or you will re sit a test, there are so many opinions around it's so difficult to know what is true and what is speculation.

I do have a lawyer and will obviously be speaking with them again but its handy to have an idea of things before hand.

It really depends on when they have appointments available.
We had to wait 5 months for an appointment to be be available for us, a friend of mine only waited 4 weeks!
I’d get a company such as One Way Services to start the ballnrolling now, they’ll then be able to inform you of dares available prior to you getting here

Speak to One Way Services. The process is straight forward and cheap to do with them and you can have confidence it will be done correctly and smooth.
Comments of months for appointments is almost scare mongering. I walked in, the made an appointment the same day and took us to get our residency 3 days later. All done the easily and quickly for 50€ each.
I would not use your solicitor, who whilst skilled would be more expensive and probably not as good as One Way who specialise in these matters and have 5 star reviews.
Phone them though (afternoons) to get the process started so you can get everything ready in advance.

Thanks Steve4878, I'm planning on using them. I've dealt with Craig a couple of times when applying to the Guardia Civil for my registering of rental guests.

It depends on when you applied for residency. 5 months last year was definitely not scare mongering as appointments for UK citizens were non existent and 5 months was what the companies who apply on your behalf were quoting. Doing it yourself was even longer.
However, the Spanish government have brought in a special procedure for UK citizens and the waiting time for a residency appointment is now very quick. One Way are very good but some solicitors are also on the ball as well. Abaco and SGM are recommended as well as One Way (we actually used One Way for our driving licences about 5 years ago and they were excellent but we used Abaco for our residency 10 years ago and they were also excellent).
