we have been in Spain on and off since May 2014 (11 weeks in total so far) and have been told we need to register as residents after 6 months (184 days)

1. what does this actually entail?

2. does this cost anything

3. since I am retired and get my UK pension is this affected - I pay tax in England.

4. my partner is younger than me and not retirement age so is not in receipt of UK pension yet - we live on my income - how will this affect him

5. we do not want to become Spanish citizens and lose out on UK rights

6. we own a British car which although 13 years old will last for many more years but have been told that we will need to register that when we become residents - also cars older than 10 years will not qualify so what do we do with our car?

If you intend to stay in Spain for more than 6 months in any year you should go onto the register of EU foreigners living in Spain.

If you do it yourself the cost is minimal, around 10 euro. If you don't speak Spanish it can be quite difficult so may cost around 50 euro to get someone to do it for you.

3. since I am retired and get my UK pension is this affected - I pay tax in England.
If it's a UK state pension then you should get the pension paid without tax in UK. You then have to complete a Spanish tax return but the allowances will put you in the no tax bracket on that basic pension. If it is a government pension then there will be no change.

Your pension will come under the allowance. His pension entitlements from UK will remain.

5. we do not want to become Spanish citizens and lose out on UK rights
You will not become a Spanish citizen nor give up your passport or anything. You will simply be on the EU foreigners register. If you intend to live in Spain you should be prepared for abiding by Spanish rules. If you do register, you and your husband will be entitled to use the Spanish NHS system free of charge (except for a 10% prescription charge up to a maximum of 8 euro per month). If you don't register you will not be entitled to any healthcare except emergency treatment which has a limited time span.

Is the car permanently in Spain? In which case it should be re matriculated onto Spanish plates. Just like UK, Spain does not allow cars over 10 years old to be imported except under special circumstances. As this process would cost about a thousand euros then it might by better to change it. It will also need to be taken back to UK once a year to get MOT, vehicle licence duty paid and so on. It must be legal in the country of residence to keep it here including insurance. You can only keep it here for 6 months anyway without reregistering it in Spain.

We have recently done this.

Step one is to go to the town hall at Playa Flamenca between 08.30 and 10.45 to make an appointment. At the same time they will give you a form to fill in and a list of things to bring to your appointment. One of the things on the list is a recent 'stamped' bank statement which my bank (Barclays Spain) charged me 12 euros for (legalised robbery).
You will also need to take the completed form to your bank and pay 10.50 euros each in taxes (more legalised robbery).

You will then attend your appointment at the same office and present all your documentation (plus copies) for examination and submission.
If all is correct you will be given another appointment to return and collect your 'residencia' card.

There are no short cuts like phoning for an appointment or going online. It has to be both of you in person.
They give appointments out in numerical order so the earlier you get there, the sooner you will get in next time.

Park your car in the Mercadona car park and walk a few minutes to the town hall which faces out onto the N-332.

Thanks very much for the most helpful advice

The only thing i am still unsure of is I get a private as well as a state pension and pay tax in England on the private pension since it takes over the tax limit. Will I have to pay tax on it in Spain as well or instead of?

Hi again,

This is a totally seperate issue from obtaining your Residencia's and you will need to seek professional advice regarding your tax affairs. You should not pay tax on your income in Spain AND Uk but these things need to be sorted by people who can advise you on which is best for your own circumstances. Hope this helps a bit.

Hi yes residencia and fiscal residencia are two different things so take advice from an expert.

your UK pension has to be taxed in UK but your old age can be taxed in spain to your benefit. After your UK pension your old age is taxed on the full amount. In Spain with your old age you are allowed 6000 Euro or so taxfree...................so much less tax for that in SPAIN. mIKE

Hi I have recently re registered my English car through a solicitor in torreveicja it is 12 years old it cost me approx. €600. Plus headlights that breaks down to €172 at itv centre in Torreveicja one off payment of €70 for engineer to translate documents €102. For itv.€120 for solicitor.they even came and helped at itv centre and notary the rest was suma and taxes. You also have to get legalised copies of passport good luck.

I got my English plated car on Spanish plates about 4 years ago and it is a 1995 306, no problems unless the laws have changed.
Ask in quesada autos on the same road as quesada fish n chips, just a little further on. He does all my mechanics and takes it for its itv test every year. Right nice bloke he is.

Hi thanks once again to all responses. Great advice about the car.

The reason I asked about the pension being taxed in Spain and the car changes as part of my forum question of residencia is that I have been told by various people that when I get my residencia then the tax and car registration come into force so NO it is not a separate issue at all.

Regarding the tax issue I do realise that I need professional advice but as this is a general forum it was a general idea of what other people recommended that I wanted - I thought that was this forum was all about
