removing a name from the padron

a family member wants to remove the name of her exboyfriend from the padron. He does not, and never has had, any financial stake in the property. He left going on for two years ago but the local townhall say they need to know were he is now registered, this information is not know, whats more the family member does not wish to have any contact him or his family, he has threatened violence in the past so it is understandable. What is the law concerning this, this cannot be a one off situation. Hope someone can advise.

Our Padron expired and we were asked to renew but we didn't need to. Therefore I would have thought that if she waits until it needs renewing she would then either not renew or just renew in one name.

IMO it has nothing to do with claiming on property possesion that's decided by what names are on the deeds but others may know differently

thanks for your reply, she was wanting to a new padron, which is when the issue arose. You do not have to own a property to be on the padron just prove you reside there. We think townhalls are reluctant to remove people as they loose revenue from central government. As you can no doubt imagine she does want to draw a line under an unpleasent and stressful time in her life and this would help do that.

Just a thought but maybe she could go in and try again to get a new Padron just for herself and not mention any partner and if they happen to see his name on the old Padron records again, she could say he's probably left the country and can't be contacted. I really can't see why they would have to know where he's gone, as she is still signing on the Padron and that helps the government.

I imagine many people move areas or leave the country without telling the Padron authorities.

Hi jan she was trying to get a new padron and she did not mention him it was the person at the town hall. Her ex is Spanish and has most likely returned to his home town. Trouble is all town halls seem to work to their own take on the rules.

The renewing padron after 2 year is only for non-residents even though non-residents are no longer required to be on the padron (back to town halls having their own take on the rules). Residents never expire but you are expected to confirm it every 5 years (there's a notice in the town hall at Rojales pointing this out).
If he is Spanish, then he should, in an ideal world, have registered on the padron in the place he has moved to which would automatically cancel his padron in Rojales.

the thing is when you do certain things, like buy a car, your padron certificate cannnot be more than three months old so you have to go and a new get one. The person concereddoes not live in Rojales. Sadly the world is far from ideal and many people are not on the padron.

My husband and I renew our Padron whenever necessary, our son lived with us here for 6 years before he went back to the UK, we just didnt renew his when we did ours. No questions were asked.

I renewed my padron when I became 65 so I could get a SIP card in my own right and change from a beneficiary of my OH. They simply replaced mine (you're right, it has to be within 3 months) but they didn't question my not renewing my wife's padron at the same time.

thanks to veryone for helpful replies. Seems that every town hall has a different rule. I think the best thing will be to insist the name is removed.
