Hi, Expert advice needed. To see if me and my partner would qualify for residency ,as my partner would have no income but i would have a smallish pension and plenty of savings. I don't want to buy a property and find out not eligible for residency.Any advice who i could go and see ? Will be over in May and January.

An obvious question - if you have a holiday home and are coming and going a lot, how (or who) calculates the amount of days you have been in Spain? Just a thought . . .

This UK Gov page gives basic requirements . . https://www.gov.uk/guidance/residency-r ... s-in-spain . I vaguely recall somewhere saying income of around €1,250/Month or substantial savings of around €200k . . . but I'm not certain . . . Any good Legal representative that you use to purchase a house would give you the accurate requirements . . . Its all based around you not being a burden on the Spanish system . . .
BTW . . . I know of several people that have lived in Spain for 12 years+ that have never applied for residency and they aren't hiding away . . . . of course it could all change in 2 years . . .

At the moment I don't believe that it's possible for them to check, as there is an open border with France so passport details aren't recorded so it's not possible for them to know who is in Spain and when they entered.
However, some of the long term 'residents' in Spain that haven't applied for residencia may find it impossible to prove that they have an address in the UK where they've spent the majority of the year.
Post Brexit is another story and will depend very much on whether some sort of visa is required to enter the EU. If this is the case then it may be limited to 3 months duration unless supported by residencia in an EU country. We'll have to wait and see...

My OH and I recently obtained residency. Neither of us qualify for a British state pension at the moment but, like you, I have a small pension. Our income comes from property we rent out in the UK. We initially applied via the office (of extranjeros)in Torrevieja and it was a nightmare. We made three trips and didn't seem to make any progress. We went to a different solicitor and were taken to the office in Elche where they barely glanced at our documents and residencia was granted. We did provide bank statements, house deeds, padron and evidence of health insurance so,as Babu says, we showed we could support ourselves.
We felt it was an important move with Brexit hanging over us. We really don't want to move back to the UK!

Hi Lyn59,who did you use to sort it out and what was the aprox cost . We are the same as you some money off rental property and and small pension and not on state pension for a few years yet.

Just referring back a few posts...the gov.uk above is very useful.
But it states...
"Residency requirements - From 28 March 2007, Royal Decree 240/07 requires that all EU citizens planning to reside in Spain for more than 3 months should register in person at the Oficina de Extranjeros in their province of residence or at designated Police stations."
So - I'm guessing that a holiday-home owner spending over 3 months a year in it would need to apply for residency...???
But it states...

I had heard it was over 183 days or 6 months you need to apply for residency.
