Is it illegal to capture a public road on CCTV?

Following break in's in our area I decided that CCTv would be a help.
The location of the sensors mean that I do capture some of the public roads, and off course that's the main purpose, looking at suspicious individuals 'casing' the joint.
I record from midnight to 8am.
I have been told this illegal.
Thoughts would be appreciated.
Is this another case of the rights of the criminal are more important than the victim?

I would like to know who told you it is illegal? in the UK now you can do it but must advertise that you are doing it, I am not sure of the exact laws in the UK and even less in Spain, have you taken legal advice or do the comments on it being illegal have some foundation, if you have told someone what you are doing and they say it is illegal and report you it may be that you could be in trouble so I would not rely on information from TQ members unless they are fully qualified to answer your question. Take the proper advice then you are beyond reproach. Interesting one!.

We have CCTV in the community but have to have signs up warning people of the fact. The company fitting them said they had to be sited on community areas only. They were careful not to have pictures of any outside areas.

See web page AGPD.es, cctv is highly legalised in Spain, you can cover your own curtilage but must not view public areas.
If you have cc tv system you must report it to the Data protection dept IF you RECORD the output. You have to have signs on view which advise people that you are using cctv on your premises.
I have not read the 56 page report but it seems much more severe than UK and the fines are much higher.
As far as I understand if you use cctv without recording you do not have to report your system to the authorities, if you do Record, you may have to.
The signs which the security firms use say,--
ALARMA con grabacion de imagenes, Aviso a Policia.

Tonemar the advice is correct always be on the right side of the law , interested to know the area your staying in just a heads up for others,another point
Perhaps someone will advise on what's the difference CCTV, and a Webcam, some of the cams show quite a lot of detail of the immediate surrounding area.

I view CCTV as a deterrent. Is a potential burglar even going to bother pursuing your property if he thinks you have CCTV?
I would consider getting some dummy cameras installed which are very realistic nowadays. www.dummycameraco.com
