catastral values on non habitable property

We have just had a claim for flood damage, . although the damage was not significant the insurance assessor has made the following comment regarding our underbuild :

"It is important to note that under the Spanish construction law, the sanitary chamber is NOT to be used as a habitable space or living area. The sole purpose is to separate the humidity from the land/ground from the habitable zone / upper living space. The insured is using this part of the building for storage when clearly this is not the purpose of this space.


The loss adjuster observed that the wall that adjoins the property with the side of the plot presents persistent humidity, produced through the years, as is obvious in these type of rooms"



So for construction purposes it is not available for storage but according to Catastral values and IBI it has been treated as exactly the same as the habitable part of the house. is this inconsistent or not?

Sorry the point is that for insurance purposes the underbuild is treated as uninhabitable but for IBI tax it seems to be treated just the same as the upstairs
