Tax Query

Tax Query

Postby TrishG » Sat Feb 06, 2021 8:41 pm

My elderly mother is in the process of having her taxes done; however, I have a couple of questions. Is it common practice for a lawyer to prepare the annual tax return in Spain? My mum is computer illiterate. My mum also mentioned she was told she needs to get a code from the Town Hall. Any idea what this code is or why it is required? My mum is a permanent resident. Cheers.

Trish I Would use a solicitor if it is your first return. I can reccomend SGM solicitors in Beniofar ,A lovely lady called Esther does mine. There are numerous others you may use.Just type in tax return s in the search in the box top right and you will get loads of answers. The spanish tax year is 1st January--31st December not like the uk.Your mam needs to write down how much she gets each month and total it up at the end. But be warned this is why i used Esther the tax people in Spain allow you no leeway or they did not me so for every day i was late they charged interest whIch was quite hefty.Lastly be aware of when you need to start pay your tax here i was told different things so ended up not paying the first couple of years i should have and got hammered. good luck.

Thanks Chris. My Mum has been a resident for several decades but has not (according to her) been asked to get a code before from the Town Hall so I have no idea what this is. My Mum is at that age where a lot of things seem overwhelming to her, so not being where she lives I was trying to educate myself. I will look at the other info on the forum. Thanks so much!

This will be the digital certificate which is required to do online transactions. They issue them at the PROP office to the left if Torrevieja Town Hall. I think she should take her residence card, padrón and passport. Best arrive around 8:30am and queue before doors open.

It'll be for the digital certificate. It allows easier access to all your official affairs online and seems to be the way forward although it never used to be the case. In Rojales it is simple to obtain. There's a thread on the subject running currently, mostly about Torrevieja, but I described the Quesada / Rojales process on there. Personally I wouldn't be paying lawyer rates for tax returns. Unless your mum has something particularly complicated it's a simple admin job for a gestor / assessor. Or maybe her lawyer has an inhouse gestor rather than doing it themselves.

Hi Trish, your Mum should not be giving her digital certificate to anyone - it's almost as bad as handing over the pin number to your bank card. If the company doing her tax returns are a professional set up, they should have their own digital certificate. Abaco Advisers in Torrevieja have been doing my tax returns for 5 years and they have NEVER asked me to hand over my digital certificate. Make sure she's using a bona fide company. Take care.

Thanks Paul. It was the tax person who told my mum she had to go to the Town Hall in Quesada to get her code. I had wondered why the tax person didn't have their own code to file my Mum's taxes. The tax person has been doing my mum's taxes for years, but obviously is not tax savvy as my mum's been paying tax on her UK pension in the UK when, apparently, as of 2015 she should have been paying it in Spain. You would have thought the tax preparer would have known that. I also couldn't understand why law firms do tax returns. Thanks again Paul. I'm worried now but I will let her know. Cheers.

Leave it to SGM Abogados and Esther, they are brilliant.
