so what happens to a couple 65 and 75, who have residencia, own a spanish house, have no will, lived here 3+ years and one dies? Does that complicate matters?

Complicate matters? How?
What bit of In the Region of Valencia, no inheritance tax or donation tax is payable between spouses; are you finding difficult?

Not having a Will could certainly complicate matters, especially if you have children (not in terms of inheritance tax due: as Marcliff has already advised, there wouldn't be any).

As you are Residents, not having a Spanish Will means Spanish succession law will prevail in the event that one of you dies (if you were non-resident, UK succession law would prevail). In the UK, a jointly owned property would pass to the surviving spouse or whoever else you choose to nominate as your benefiary. However, in Spain, if you have children, they inherit jointly with the surviving spouse. To negate the Spanish succession laws, you should make Spanish Wills, specifying that you wish to invoke UK succession laws.

Make a will directly at the notary. 50 euro each. Maria consulting at los montesinos was very help full to us recently regarding inheritance. 1700 euro for various fees , no inheritance tax to pay. Notary fees, her fee and land registry fees. Still waiting to get the castral valour bill from the town hall.

I've just seen that the Andalusia government have made it almost nil tax to pay 99 percent relief.
