Rules for 2021

Hi everyone hope everybody is fine , a question that I cannot find a definite answer for.
I fully understand both the 90 day rule and the 183 rule regarding stay for a non resident, but a question i have been asked is if a person arrives in Spain before the end of the year and stays till February will the days after the 1st of January count against their first 90 or not due to the U.K. not exiting the E.U till midnight on the 31st of December.

As the new 90 day rule begins at the end of the UK transition period which is midnight on 31st December, logic would suggest that's when the clock starts ticking.

I can confirm Sage is correct.

A new 90 days starts afresh on 1/1/21

That date seemed so long away once didn't it?

And can I ask a stupid question....

If I come back on 22 January does my first 183 days start then or is it effectively 90 days in the first half of the year and 90 days in the second half?

If you come back on January 22nd you can stay for 90 days. You then can't return to the EU until after another 90 days. So yes you can only stay 90 days in each half of the year

My question is, where do they start counting the days, the minute you land in Calais or the minute you cross the border at La Jonquera or Irun or coming through Andorra? Who records your arrival date and departure date? Are they reopening the border checks for Brits, I have a English Motorhome but I also have a spanish registered car? If I traverse customs in my motorhome, but travel home in my Spanish car after 90 days then go back in my Spanish car after 90 days then 90 days later come back in my motorhome how can they possibly know? I recon no one would ever know, so just ignore all the rules and carry on regardless..

The minute you land in Calais. The rule is 90 days in 180 in the EU, not in one particular country.
They will know because, unlike now, your arrival and departure dates will be recorded. Whether by stamp in the passport or electronically.

Andorra has a border control union with the EU.

Thank you marcliff, it won’t be long then until Spexit, Spain can not afford to lose the British villa owning tourist they spend far too much, look at the shutdown, bankrupt benidorm? The British who spend 6-7 months at Vilasol and vilamar campsites near the Benidorm market will move on if it’s only 90 days in every 6 months..
