Help please to calculate 90 days in 180 days.
by RH1 » Wed Jun 02, 2021 6:59 pm
Have tried the calculators on line and stuck!! We are thinking of 60days at the end of June which will end at end August - we then have 30 days left from the initial 90 days allowed - but if we use the remaining 30 days at the end of the initial rolling 180 day period ie end November to end December can we then use the first 60 days from the next 180 day rolling period ie Jan to June 22? Simply put do we have to fly back to the UK at end December and out again on 1st January 22? Any advice will be appreciated.

Hi ,I think the 180 days is in a 12 month period you do your first 60 days then go back home, come back and do you remaining 30 daysthis i think is when you can't return fo 90 days,so it basically 90 in and 90 days out in a 12 month period not a calendar year.

Wiliam is quite right - its 90 days in EU and 90 days out of EU, in principle. The regulation is 90 days in any 180.
There are some calculators that help with the complications of overlapping periods. Hard to explain without going through the actual days.

To take your dates to the extreme, purely as an example as to why you may not be required to return to the UK at end Dec 2021.
Enter EU 30/06/2021 60days in EU
Leave EU 28/08/2021
Out of EU 90days UK (IT IS THIS "out of EU" break that makes the next bit allowable)
Enter EU 27/11/2021 90days in EU
Leave EU 24/02/2022
if you shorten the "out of EU" break (to re-enter the EU before 27 Nov.) you immediately run into a problem with 90/180 on the count that began 30th June - if you did not leave at end Dec - (if your passport stamps were later examined in detail - the likelihood is arguable but I will not risk it)
Remember that your entry and exit days count in your allowable 90 (even just before and just after midnight)

What ever day of a year you arrive in Europe, that is the day your 180 days starts.
You then have up to 90 days to use in Europe during that same 180 days. Come in and out of Europe as often as you please, as long you don’t spend more than 90 days in that same 180 day period, in Europe. It’s that simple.
Once that 180 period is up, then that’s over. the next period of 180 days starts, the next date that you arrive in Europe, and around you go again.
I suppose it’s easy to over think it, but that above, is it.

We checked our dates using the Schengen-calculator.com and it tells you exactly when you can enter and how many days you have overrun. I found it very useful booking our flights.

The basic query we have is - can one end the first set of 90 days on say 31 December and remain in Spain without flying home to start the new cycle of 90 days (in the next 180) on 1st January 2022?
Realistically this would mean travellers could use the last 30days moving onto the first 90 day allowance of the next 180 day period - or - stay for 120 consecutive days? Somewhere there may be a legalistic barrier to combining the allowed days of 2 periods perhaps insisting on a departure and re-entry.... Would very much welcome any more help TIA

You keep referring to calendar years. The 180 days start on the date you arrive in the EU.

There is no such thing as a rigid 180 days.
The 180 day period never ends. Its a rolling 180 days.
In other words how many days have you spent in the EU in the last 180 days counting back from today.
And when next Saturday comes it would be how many days have you spent in the EU counting back from next Saturday.
It is difficult to get your head round at first.
But try to remember 180 days started not the day you arrive in Europe, but 180 days before you entered Europe. (So, how many days have you been here in the last 180) And, 180 days never ends
Try the calculator
