How difficult is it to buy out the other partner and what would be the tax implications be to both parties. The value of the property approx, 150000 eur.

Agree, legal advice the best option, they might even tell you how much it will cost.

Here is an article for you explaining the costs. Luckily in the scheme of legal things to do with property in Spain it looks quite reasonable at 1.5% stamp duty on the portion you are buying. Plus legal and Registration costs.

The partner receiving the money will be taxed but in Comm Valenciana that should also work out quite reasonable.

Very much depends on how willing partner is !!!!!
Also how is valuation to be determined.

Valuation is not a problem as Hacienda will have an official figure and if you disagree with that then you can provide figures for similar properties sold in your area. Www.Registro.es has a facility to give you the official valuation figure for your property.

Not sure if you have got sorted but please find details of my solicitor dealing with the sale of my property, in case you need legal representation.

I find him very reliable and quick to respond… even while on holiday.

I was getting quotes of €20,000 + just to remove my ex wife’s name off the deeds and mortgage.

In my circumstances……. It was cheaper for me to sell the property….. which after 3 years and a reduction of €100,000 I finally sold it last week!!!!
