Co-signer refusing to sign off a bill

We live in UK but own a property in Spain. There is an outstanding lawyers bill that one of the co-signers is refusing to sign off. (No one knows why) All of the members of the community voted and the majority agreed that the bill needs to be paid. Is there anything we can do?

As you as a community cannot fine people, I found the way round it was to double the community charge to everyone but give a 50% discount to all those that were up to date with ALL payments. This focused a lot of minds in my last community, but, this needs approval of your AGM normal or special.

Many thanks for the reply but we are trying to find a way we can bypass the cosigner or remove her from this position as we all fully understand the bill needs paying or the lawyer will end up taking us all to court over his unpaid fees.

If the fees to the lawyer are a community expense then surely the reqirements of the Horizontal Property Law will come into force whereby you requre 2/3 of the commity to vote and agree for the outstanding fees to be paid.

We did have the vote and over 2/3 voted in favour of signing. The papers were sent to the cosigner but she just ignored them and the time limit for her to sign expired. So we can't seem to move on unless she signs the paperwork but it appears that she has no desire to sign and can't forcefully make her.

Could you denounce her for dereliction of duty or something similar?

I think we may have to but we all really don't want a long drawn out process. We'd love just to agree to have her removed as cosigner and have someone else in the role who will sign the documents. It's all very tiring.
