I live in a street where the water distribution and meter are positioned at the top of the street. I am now aware that the water supplier is responsible for leaks up to that . distribution point. From the meter, the water pipes run under the pavement then into each individual property up to a stop cock (usually under the sink). Last week the water supplier isolated my next door neighbours water supply as there was a leak between the meter and his property. It turned out to be under the pavement about 40 metres from his house. There is now some dispute as to who is responsible as the supplier claims they only deal with leaks up to the metering point and the insurance company says that as the leak was not on his actual proper ty but a public throughway, he is not covered under his policy. Should the Ayuntamiento be reponsible (under discussion), if not then who?

The Ayuntamiento is not responsable about that. The rules are clear about as you said. How built the house decided where to put the meters so....

Are you saying the company who built the houses in our street are responsible for any damage to services where meters are some distance from the house i.e. water and electric? I find it hard to believe that the Ayuntomienta don't take over the manitenance of these services such as street lights, gas, water and electric running under public throughways, once the finished buildings have been approved and signed off.

we had this also , water company only responsible TO METER, anything else is yours.
our community has insurance that covered the repair and if loss is over 150 cubic metres the water company will come to an agreement with you over cost of water.
we had to pay over 200 euro. we turn off at meter now each time we leave .
it has nothing to do with town hall im afraid .

:( i should have added that our own property insurance only covers for leaks ON our property. we were lucky that our community had the foresite to include it in their policy . we are also respinsible for our street lightinglighting, drain cleaning and resurfacing /repairing roads.
if you have a president/ administrators maybe ask them if you are covered under your community .

We appear not to have a community as we are simply a street with semi and detached properties, no communal pool or special entrances. Does anyone know about the legalities of situations like this?

Who would be responsible for mess made to a property, where the neighbouring property had a leak. Having to then have a new pipe to their home from the water source, whilst the works were being carried out, tarmac, concrete and concrete dust have been splashed and splattered all over my property and my garden, left in an awful state after the repairs for next door. Could anyone advise if this is worth me pursuing after being left with the inconvenience and clean-up, in an area where we are not meant to allow water to pour on to the road?.

See next door ,ask them who ever repaired pipe should have left the area as they found it,thats only right, that's what any good,resposible workman would do, well I would,

@Glassman. Yes this is what you would assume, Silaqua are the company and according to their webpage they work clean and professionally, not with the broken tiles and mess they left behind, they don't. The neighbouring thoughts are "oh well, this is the way when work is carried out at a property?, I'm pretty dumbfounded as to the lack of professionalism woth the company, as im pretty cetyain they wouldn't be happy home to such a mess.

I would also like to point out that this is of course a minor issues compared to those that have experienced such upheaval with the recent flooding. Which makes a neighbours water leak seem ironically mocking. My lack of Spanish prevents me from expressing how I would like to, to the company responsible and obviously don't hold the neighbours responsible by any means. It's just baffling.
