I'm in the process of making my Spanish will with Pellicer & Heredia at the top of Quesada high st very good service at reasonable cost

We used Abaco and did it online with them. Fast and efficient service. They sent us forms to fill in online and they sent the will back to check and the only time we went into the office was when the wills were signed.

Sounds great service Jan. I was using VM Solicitors in Torre who included it in the cost of the conveyancing for my house. However 11 months later they still had done nothing so hence I had to change. Pelicer & Heredia had it done in 2 weeks

I think some of the will making is a bit dodgy and a bit too easy.

For instance... the first easy one is... "If I die first, everything goes to my spouse"..that is simple nd what many put in a will. But...in this time of air travel, train travel etc... what happens if you both die at once in say, a crash..? where does the money go then..?.. how is the estate split up..?

More complicated...nowadays, many families have broken up and people remarried and there are two lots of children.

..What happens if in a car crash the wife dies first(everything goes to spouse). All the assets would go immediately to the survivor.... ie husband... then he dies a couple of days later. .. Unless specified, everything goes to HIS family... deceased wife´s family would get nothing...unless the will is contested and even then nothing is sure... and it could take years.

Suppose the child that is left inherits everything...he/she might be 12 or 13 years old... they would have immediate access to perhaps 200,000 quid. It could be all gone in a couple of weeks.

Would it be better to have stipulated in a will that some of the money be put in trust for University... or to buy a house?.. maybe give 25% now and put 75% in trust until age 20?

As can be seen, it can get very complicated very fast...just make sure you spend a little while thinking about the consequences before signing..

could you give me a rough idea of cost with Abaco sounds by far the easiest way

The will should comply with EU legislation and you can state it should be executed under the law of your home country and your wishes should be adhered to as opposed to your assets being disposed according to Spanish law. Costs for my will with Pelicer & Heredia is around 250€ but costs will vary depending on the lawyer. Bur ask for the cost first

You can do that now as we are all in the EU...you can have your will executed under any EU country..

Not sure what will happen after the UK is not in the EU anymore..
