Just to add to this I asked Matt at One Services if he could apply for residencia for non-residents for us as we stayed over 3 months and he said there is no such thing. You can only apply for residencia if you spend more than 6 months in Spain and it is your main residence, even though the form you fill in says anyone staying over 3 months should apply. He said that we are automatically registered as a foreign national by virtue of having an NIE number as that means "Numero Idenficacion Extranjeros" or something like that.

I'm just crossing my fingers.

There is a non resident certificate you can get if you are staying over 3 months but less than 6 months. It is done on the same EX18 and there is a bit at the bottom for temporary resident. This is valid for 2 years and has to be updated after that and is probably the same thing the bank charges non resident for every 2 years anyway except you don't get a certificate.

However, I would suggest it would be a waste of time at the moment. It is taking up to 3 months to even get an appointment so by the time you get one you'll be in your last 3 months. The temporary resident bit for EU citizens is what you'd be after but, again, this will probably not be valid after the end of March and you won't get an appointment to do it before then.
