Having the camera is perfectly legal. However, by the Spanish law of data protection, the camera images are not admissible in Spanish court proceedings because you have recorded someone in the public way without their permission.
But wait a minute. The images may well be useful when two automobile insurance companies negotiate out of court to determine responsibility for an accident. They could be used to confirm eye-witness accounts, for example.

Yes, they're legal to use in Spain, although you might have a problem if you upload footage to YouTube or Facebook without blanking-out numberplates or anything else that could identify an individual person or vehicle.

Where there's any doubt about what happened in an accident or who is to blame then having dash cam footage available is always a good thing. It might not be admissible as evidence in terms of prosecuting a 3rd party, but it's always good to be able to produce as verification about what actually happened and save your no claims bonus.

Dash cams and sat navs need to be positioned so that they don't obstruct the drivers vision of the road and shouldn't be touched by the driver whilst the vehicle is moving. If your dash cam has a screen then it shouldn't be on while the vehicle is moving so as not to distract the driver.

I personaally use a Mobius action cam with a wide angle lens (Lens C).
https://www.joovuu.com/gb/action-cameras/61-mobius-action-camera-wide-angle-lens.html
This doesn't have a monitor, so you need to take the micro SD card out and view the footage on a laptop or tablet (or pop it in your Android phone if it has a micro SD card slot), but it's very small and easy to mount.
You need to use a decent quality memory card (I always use a 32gb Sandisk).
The Mobius produces great quality footage at night. Avoid cameras with infra red LEDs to provide night vision. The infra red light reflects off the inside of the windscreen and produces flare and even if that didn't happen the IR light doesn't shine far enough to clearly illuminate anything beyond the end of the bonnet. Much better to go for a camera that has good low light performance, like the Mobius or similar.

Use it regardless of the law, cover your ass.
I got a call from my insurance company saying I was involved in an accident with my car in the north of Spain.
Went round to my Local agent plugged my card into their monitor which showed at the given time of said accident I was travelling through Quesada arches time and date stamped.
End of any alleged claim.

Funny I also had a call from my insurance company saying I had a minor accident, told them don't know what they are talking about and offered to let them check out my car no bumps dents nothing they declined.

Not had anything back that was about 8 months ago. So yes may buy one and just like Mailey said.

Thanks to all. Pete.

what would be the point of a dash cam if it could not be on whilst the car is in motion. sat navs are allowed. however, i know televisions have to be situated in the rear of a vehicle so that the screen is not a distraction to the driver. On this point i had correspondence with ROSPA and various other Gov. Depts. that sat nav screens could be a distraction to drivers in the same way. no clear response from them. Manufacturers of cars are being allowed to incorporate satnavs, etc on dashboards on new cars. in my opinion these are just smaller tv screens with a different purpose but still a distraction whilst driving.

The dash cam can be on (i.e. recording) while you're driving, but the viewing screen should be blank. Many dash cams which are fitted with screens have a setting that allows you to control this, often defaulting to showing the image from the camera for the first 5 seconds then blanking the screen.

It is legal and the Guardia Civil say 'it would be very helpful if all cars would have one'.
And the videos can be used as evidence in accidents/incidents.
