Urbanisation fees not paid

I am a president of an urbanisation in Quesada and would like help from any other president with advice on retrieving large amounts of outstanding fees. We have several owners who are in debt but still let out there properties and use the pool. Any advice would be appreciated as we are getting nowhere with our administrator.

If that is the case you need to change your administators they are supposed to guide you through the process.

Try Steve and Ian they seem to do a good job.

I personally feel quite strongly about people renting their properties out who don't give a damn about whether they owe community fees or not but quite happy to take the rent from tenants! I wonder how many of these declare the monies for Spanish taxes on the rentals? I don't think renters should have use of the community pools personally but i spose if you rent for a holiday you want to use the pool & it isn't their fault if owners decide not to pay their community fees..

We have a number on our community" they turn up every year to use 'their' apartment, which they are in arrears on even the mortgage. Our managing company changed the pool locks and you have to be up to date to get a new key. Also they have for the last two years tried to instruct uk collection agencies, not much happening there. Also they pal up with other visitors to borrow a key to get one cut. So basically you are a hiding to nothing. I have stopped going in the summer months as I can't stand the sight of them, as my fully paid up bills are paying for their free holidays!

I read in a Free Spanish newspaper about 1/2 years ago of a case thrown out of court where some urbanisation tried to reclaim unpaid fees. The judge ruled that it was not a criminal offence but was purely a civil debt, which I understand is very difficult to pursue in Spain.

We changed the lock on the pool. The key cannot be copied.. it was quite expensive.

..we agreed at the AGM that the new keys would be distributed when the fees were paid..No payment, no pool key.

Almost everyone has now paid their fees.. :D

Our administrators seem to be getting on top of the debts by using a solicitor to send out letters to debtors in their own country in the first instance and the debtors are told that they will be pursued through the courts in their own countries too if the overdue fees are not paid. The letters seem to be helping. We also have keys to pool which are changed each year and only given to fully paid up residents and the keys are special security keys which are difficult to copy.
Our Administrators in the last few years have been proactive and good, after the first few years of a few 'not so good' Administrators which were changed.
Our Administrators are Servigest Torrevieja. They have online office access for all their residents and we are pleased with the service where we can see all past meeting minutes and all letter copies and other information. After being left in the dark with the previous Administrators companies in the early days of our community we seem to have struck oil now and things are much better.

Hi ravead, it is annoying when genuinely decent owners keep up to date with their fees and a handful refuse to pay up. Our president suggested changing the locks and keys to the pool area to security keys, and also pursuing them through the courts in their own countries. So far, the key issue seems to be working, but haven't heard how the court issue is progressing as I haven't been out for 18 months. I'm on the La Marina Urb. Good luck with your pursuance of them, it's a pity their properties cant be seized and secured until all outstanding debts are paid off. That would put paid to them renting their properties out. Mal

Very well sais it realy anoys me also I pay fees like the rest of us and we to get these people that not only use the pool the kids also break parts that people like me have to pay for and We never use the pool. :text-givemebeer:
